PSI says MK ruling reinforces development of Nusantara Capital City (IKN)
Jakarta — The Secretary-General of PSI, Raja Juli Antoni, said that the Constitutional Court’s ruling on the status of the state capital provides legal certainty for the continuation of the Nusantara Capital City (IKN) development.
“The Constitutional Court’s Decision No. 38/PUU-XXIV/2026 reinforces that the development of Nusantara Capital City (IKN) is on a constitutional footing and has strong legal certainty,” Raja Juli said in a statement on Tuesday, 19 May 2026.
He noted that Jakarta’s status as the current capital does not hinder the IKN’s development. This is because President Prabowo Subianto’s administration also aims for IKN to become the national political government centre by 2028.
“Jakarta’s status as a transitional capital does not impede the ongoing development or the phased operational preparations of the IKN as the national political government centre in 2028,” he added.
“Setting the timing of the capital’s relocation via a Presidential Decree is a constitutional government prerogative based on national readiness, and thus still ensures legal certainty and ongoing governance,” he emphasised.
Earlier reports indicated that the MK rejected in full the petition to judicially review Law No. 3 of 2022 on the IKN, so Jakarta remains Indonesia’s capital for the time being.
The ruling hearing No. 71/PUU-XXIV/2026 was chaired by Chief Justice Suhartoyo in the MK’s Plenary Court, Building 1, on Tuesday, 12 May 2026.
“The court rejects the applicant’s request in full,” Suhartoyo said in the ruling read aloud.
The court also stressed that there is no suspended or vacated legal status. The MK’s ruling states that Jakarta remains the state capital until a presidential relocation decision is signed.
Separately, the spokesperson for the IKN Authority, Troy Pantouw, said they respect the entire constitutional process taking place at the MK as part of Indonesia’s democratic and rule-of-law framework.
Troy emphasised that the IKN development continues according to the phases set by the government. He noted that construction of basic infrastructure, the government district, the business ecosystem, and public services in the IKN area shows positive and consistent progress.
“We call on all parties to continue to maintain optimism, stability, and public trust in the IKN development as part of Indonesia’s effort to become more advanced, modern, and competitive,” Troy said on 15 May.
