Prosecutors Request Judge to Reject Roy Suryo's Exception
Public prosecutors have requested the judge to reject the resistance or exception filed by the defendant, Roy Suryo. The prosecution emphasised that the indictment against Roy Suryo regarding the alleged fake diploma of the 7th President of Indonesia, Joko Widodo, complies with the law.
“We request the panel of judges examining and adjudicating this case to issue an interlocutory decision as follows: to reject the resistance or declare the resistance of Roy Suryo’s counsel inadmissible,” stated the public prosecutor at the East Jakarta District Court, East Jakarta, on Monday (5/10/2026).
The prosecution asserted that the indictment prepared against Roy Suryo meets both formal and material requirements. Furthermore, the prosecutors emphasised that the indictment was drafted chronologically using clear language, ensuring the defendant can understand the contents of the charges brought against him.
“The indictment covers all elements of the offence as determined by law in a complete manner, based on the interconnected testimonies of witnesses and other evidence in the case file that contains facts and incidents. Every fact and incident accurately depicts the juridical qualifications of the elements under Article 75, paragraph 2 of Law No. 20 of 2025 regarding the Criminal Procedure Code (KUHAP),” the prosecutor said.
Additionally, the prosecution requested the panel of judges to declare that the East Jakarta District Court has the authority to adjudicate Roy Suryo’s case. The prosecution also requested that the judge order the trial to proceed to the merits of the case.
“To continue the examination of the case in the name of the defendant, Roy Suryo,” they added.
The panel of judges will hold a hearing for the interlocutory decision on Monday (19/10/2026).
“The judges’ deliberation for the decision will be read on Monday, 19 October 2026, at 09:00; the defendant must remain present in the trial,” stated the Chief Judge.
Roy Suryo’s Indictment
Previously, Kanjeng Raden Mas Tumenggung Roy Suryo Notodiprojecto, known as Roy Suryo, was indicted for slander and defamation of the 7th President, Joko Widodo (Jokowi). Prosecutors stated that Roy Suryo disseminated false information regarding Jokowi’s diploma.
The public prosecutor indicted Roy for alleged defamation, slander, and violations related to the ITE Law (Electronic Information and Transactions Law). Prosecutors stated the case began on 26 March 2025. At that time, according to the prosecution, Jokowi was presented with two YouTube uploads and one post on social media X that were deemed to attack Jokowi’s honour.
“There were three social media uploads, consisting of two YouTube videos and one post on X, attacking the honour or reputation of witness Ir H Joko Widodo, which essentially accused that the undergraduate (S-1) diploma of witness Ir H Joko Widodo is fake,” the prosecutor said while reading the indictment.
“The uploads include the YouTube account @EggiSudjanaChannel titled ‘Consistent TPUA Disclosure of Fake Diploma’, and the X account @DokterTifa titled ‘ERA AI: All Fake Diplomas Will Be Revealed in Seconds’,” the prosecutor added.
Jokowi subsequently contacted his legal counsel regarding the matter. Once assembled, Jokowi’s legal team held a press conference to refute Roy’s allegations.
Universitas Gadjah Mada (UGM) also held a press conference, stating that Jokowi was a registered student at UGM and had successfully graduated. Prosecutors stated that Roy’s actions caused Jokowi immaterial loss as his reputation was tarnished.
“There were even parties who joined in accusing witness Ir H Joko Widodo of using a fake S-1 diploma to meet the requirements for previous public office candidacies, namely Mayor of Solo, Governor of Jakarta, and the 7th President of the Republic of Indonesia,” the prosecutor noted.
Prosecutors stated that the S-1 diploma analysed by Roy using the Error Level Analysis (ELA) method did not originate from the legitimate owner of the diploma, namely Jokowi. Prosecutors claimed that Roy failed to perform verification or seek permission from Jokowi to distribute the document.
“Furthermore, there was no effort from the defendant to perform verification, confirmation, or request permission from witness Ir H Joko Widodo as the legitimate owner of the document, such that the Electronic Information and/or Electronic Documents used as the basis for the defendant’s analysis were obtained without authorisation,” the prosecutor said.
As a result of his actions, Roy is charged with violating Article 433 paragraph (1) in conjunction with Article 441 paragraph (1) of Law Number 1 of 2023 regarding the Criminal Code, subsidiarity of Article 35 in conjunction with Article 51 paragraph (1) of Law Number 11 of 2008 regarding ITE in conjunction with Law Number 1 of 2026 regarding Criminal Law Adjustment, and Article 32 in conjunction with Article 48 paragraph (1) of the ITE Law in conjunction with Law Number 1 of 2026 regarding Criminal Law Adjustment.
