Prosecutors Rebut Ibrahim Arief's Claim on Rp 16.9 Billion Restitution in Chromebook Case
JAKARTA, KOMPAS.com - The Public Prosecutors (JPU) have rebutted the amount of restitution of Rp 16.9 billion demanded against former technology consultant Ibrahim Arief, stating that it did not emerge suddenly. The figure is said to be a fact revealed in the trial.
“It didn’t come out of nowhere. It emerged from facts uncovered in the trial,” stated Head of the Prosecution Team Roy Riady after the hearing at the Jakarta Corruption Court, Thursday (16/4/2016).
During the same period, Ibrahim, alias Ibam, was involved in the procurement of Chromebooks.
“The prosecution assesses that from facts revealed in the trial, from document letters as well as expert witness testimonies, there was an increase in the defendant’s wealth, Ibam, during the timeframe of the Chromebook procurement incident when he was the technology consultant for the Minister in the ministry, something like that,” Roy explained.
Furthermore, he assessed that Ibrahim could not prove the reverse regarding the Rp 16.9 billion increase, which constitutes his Bukalapak share investments.
“Mr Ibam himself could not prove otherwise whether that wealth increase was indeed not from the proceeds of the crime in this case, namely the Chromebook procurement,” he added.
The JPU is demanding a 15-year prison sentence for Ibrahim Arief, along with a fine of Rp 1 billion or subsidiary 190 days imprisonment.
He is also demanded to pay restitution of Rp 16.9 billion or subsidiary 7.5 years imprisonment.
In the indictment, Ibrahim is not accused of enriching himself alone, but of jointly committing unlawful acts.
In this case, Ibrahim, commonly called Ibam, is believed to have prepared a technical study referencing a specific product, namely Chromebooks.
Additionally, Ibrahim presented several materials to ministry officials. This presentation influenced the ministry officials to select Chromebooks as the product for procurement.
Meanwhile, the other two defendants, Director of SD at the Ministry of Education, Culture, Research, and Technology in 2020–2021 as well as Budget User Representative (KPA), Sri Wahyuningsih, and Director of SMP at the Ministry of Education, Culture, Research, and Technology in 2020–2021 as well as KPA, Mulyatsyah, are each demanded six years imprisonment with a fine of Rp 500 million.
“Prosecuting so that the panel of judges imposes a prison sentence of six years with a fine of Rp 500 million or subsidiary 120 days imprisonment on the defendant,” stated JPU Roy Riady while reading out the prosecution’s demands.
