Prosecutors Insist on Death Penalty for Crew Members Carrying 2 Tonnes of Meth, Habiburokhman: The Death Penalty Must Be Applied Selectively!
Jakarta, VIVA – Chairman of Commission III of the Indonesian Parliament, Habiburokhman, affirmed that the death penalty is an alternative punishment that should be applied selectively in accordance with the Criminal Code (KUHP).
This was conveyed by Habiburokhman in response to the Public Prosecutor of the Batam District Attorney’s Office, Riau Islands, who remains adamant in seeking the death penalty for six crew members of the Sea Dragon Terawa, including Fandi Ramadhan, who were carrying nearly 2 tonnes of methamphetamine.
Currently, Commission III of the Indonesian Parliament is holding another meeting regarding the death penalty sought for Fandi Ramadhan in the 2-tonne methamphetamine case.
“For the case of Fandi Ramadhan, we would like to reiterate that the death penalty is an alternative punishment as a last resort that should be applied very selectively as stipulated in the Criminal Code,” said Habiburokhman during the meeting on Thursday, February 26, 2026.
Habiburokhman also requested that the Deputy Attorney General for Supervision reprimand the public prosecutor, Muhammad Arfian, at the Batam District Court, who allegedly stated that the Indonesian Parliament was interfering in the case of Fandi Ramadhan.
“We request that the Deputy Attorney General for Supervision reprimand the public prosecutor, Muhammad Arfian, at the Batam District Court, who implicitly but very clearly stated that the public and the Indonesian Parliament were interfering in the case of seeking the death penalty for Fandi Ramadhan,” he concluded.
Previously, it was reported that the Public Prosecutor of the Batam District Attorney’s Office, Riau Islands, stated that they would continue to seek the death penalty for six crew members of the Sea Dragon Terawa who were carrying nearly 2 tonnes of methamphetamine.
This demand for the death penalty remains despite criticism from the Chairman of Commission III of the Indonesian Parliament, Habiburokhman.
This statement was made by the Public Prosecutor during the hearing on the response to the defendant’s plea (replik) at the Batam District Court on Wednesday, February 25, 2026.
“In principle, we as the public prosecutor remain with the criminal charges that have been read on Thursday, February 5, 2026,” said Public Prosecutor Muhammad Arfian during the trial.
The six defendants, including two Thai citizens, Teerapong Lekpradube and Weerepat Phongwan, and four Indonesian citizens, namely Fandi Ramadhan, Richard Halomoan, Leo Candra Samosir, and Hasiholan Samosir, were charged with the death penalty by the Public Prosecutor of the Batam District Attorney’s Office.
