Prosecutors File Appeal Against Acquittal of Delpedro and Associates in August 2025 Demonstration Case
JAKARTA - Public Prosecutors (JPU) have filed a cassation appeal against the acquittal of Lokataru Foundation Executive Director Delpedro Marhaen in the case of alleged incitement related to the August 2025 demonstrations.
In addition to Delpedro, the prosecutors also filed the appeal for three other defendants: Lokataru Foundation staff Muzzafar Salim, administrator of the @gejayanmemanggil account Syahdan Hussein, and Universitas Riau student Khariq Anhar, all of whom were acquitted.
“It is true, and the reason the JPU filed the cassation is because the case was transferred on 9 December 2025,” said Head of the Legal Information Centre (Kapuspenkum) of the Attorney General’s Office (Kejagung) RI Anang Supriatna to Kompas.com on Tuesday (7/4/2026).
The provision states that criminal cases that have been transferred to court and begun examination before the enactment of the 2025 KUHAP shall continue to be examined, tried, and decided based on Law No. 8 of 1981 on Criminal Procedure Law.
“Except for the review process, the provisions of the 2025 KUHAP apply. Thus, for the case of Delpedro Marhaen Rismansyah et al., which was decided with acquittal (vrijspraak) during the examination period, legal remedies still refer to Law No. 8 of 1981 on Criminal Procedure Law (old KUHAP), so cassation is pursued for that case,” said Anang.
“Declaring that defendant I Delpedro Marhaen Rismansyah, defendant II Muzaffar Salim, defendant III Syahdan Husein, and defendant IV Khariq Anhar have not been legally and convincingly proven guilty of committing the criminal offence as charged in the first indictment, second indictment, third indictment, and fourth indictment,” stated Presiding Judge Harika Nova Yeri in the verdict hearing at the Central Jakarta District Court, Kemayoran, on Friday (6/3/2026).
“Acquitting the defendants from all charges of the Public Prosecutor,” she continued.
The Presiding Judge also ordered the four defendants to be released from detention after the verdict was pronounced.
The judge further requested that the rights of the defendants in terms of ability, position, dignity, and honour be restored.
