Prosecutors Consider Appeal Against Light Sentence for Former Sumbawa BPN Head

The West Nusa Tenggara High Prosecutor’s Office has not yet decided on further legal action against the light sentence given to Subhan, former head of the National Land Agency for Sumbawa and Central Lombok. Subhan is one of the defendants in a corruption case concerning land acquisition for the MXGP Samota circuit in Sumbawa, West Nusa Tenggara.

Muhammad Harun Al Rasyid, Head of Public Information at the West Nusa Tenggara High Prosecutor’s Office, said no appeal has been filed against the sentence imposed on Subhan, who was previously sentenced to 15 months in prison. “We are still considering it,” Harun said on Thursday (20/8/2026).

Harun said the ruling by the Mataram Corruption Court was not in line with the prosecutors’ demands. He added that the written copy of the judge’s decision had not yet been received. “We will first study the contents of the ruling,” he added.

Subhan was also ordered to pay a fine of Rp50 million, with a subsidiary sentence of 50 days. In the ruling, the panel of judges chaired by Lalu Moh Sandi Iramaya declared that Subhan was not proven to have committed a criminal act under the primary charge brought by prosecutors. “The defendant is acquitted of the primary charge,” the judge stated.

Subhan was sentenced to 15 months in prison under Article 604 in conjunction with Article 20 letter a and b of Law Number 1 of 2023 on the Criminal Code, referring to the subsidiary charge.

The sentence was lighter than the prosecutors’ demand. Subhan had previously been sought to be sentenced to three years in prison and a fine of Rp500 million, with a subsidiary sentence of 140 days. In their demand, prosecutors asked the judges to declare Subhan guilty of violating Article 603 in conjunction with Article 20 letter a or b of Law Number 1 of 2023 on the Criminal Code.

In this case, Subhan was a defendant alongside Pung Saifullah Zulkarnaen, head of the Public Appraisal Services Office, and Muhammad Jan, branch head of the same office. For those two defendants, the West Nusa Tenggara High Prosecutor’s Office has filed an appeal after the judges handed down acquittals.

The Sumbawa Regency Government purchased 70 hectares of land from former East Lombok Regent Ali Bin Dachlan for Rp52 billion. The land purchase took place in 2022. Investigators found state losses of Rp6.7 billion in the land acquisition process. The state losses have been returned to the West Nusa Tenggara High Prosecutor’s Office by Ali BD as the party who received the payment.

At the time of the land acquisition, Subhan served as head of the Sumbawa National Land Agency and acted as chairman of the land acquisition implementation team. Pung Saifullah Zulkarnaen and Muhammad Jan served as the appraisal team from the Public Appraisal Services Office.
