JAKARTA, KOMPAS.COM - The procurement project for satellite user terminals at the Indonesian Ministry of Defense (Kemhan) is alleged to have been carried out without legitimate budgeting.

“The project was not paid for by the Indonesian Government because it lacked budget (APBN),” stated the Military Prosecutor while reading the indictment at the High Military Court II in Jakarta on Tuesday (31/3/2026).

The prosecutor noted that the satellite user terminal procurement project was executed without legitimate budgetary support in the Budget Implementation List (DIPA) of the Ministry of Defense for 2015 and 2016.

The procurement of satellite user terminals in the 123 degrees East Longitude orbital slot was for the period 2012–2021.

He is also alleged to have appointed Anthony Thomas Van Der Hayden, a United States citizen, as an expert and project intermediary without adequate expertise verification.

In addition to the two defendants, another defendant, CEO of Navayo International AG, Gabor Kuti, did not attend the trial as he remains a wanted person (DPO).

Prosecutors also revealed procedural violations in the procurement of goods and services.

Anthony is said to have prepared the technical specifications and estimated price (HPS) himself, which was deemed inaccurate. Furthermore, a Certificate of Performance (CoP) was issued for goods shipped by PT Navayo International, even though the equipment had not undergone feasibility testing.

Due to the contract made unlawfully and stalled payments, Navayo International sued the Ministry of Defense at an international arbitration institution (ICC) in Singapore.

In that case, Kemhan RI was ruled to lose and was obligated to pay the principal debt along with interest.

Based on the 2022 BPKP Audit Results Report, the actions of the defendants caused a state financial loss of Rp 306 billion.

The defendants are cumulatively charged with violating Article 2 paragraph (1) jo Article 18 of Law No. 31 of 1999 on the Eradication of Criminal Acts of Corruption as amended by Law No. 20 of 2001 jo Article 55 paragraph (1) first of the Criminal Code.

As a subsidiary charge, the defendants are also charged under Article 3 jo Article 18 of the Anti-Corruption Law jo Article 55 paragraph (1) first of the Criminal Code.
