Jakarta (ANTARA) - The Jakarta Military Court II-08 held a session on Monday for the reading of prosecution demands against the defendants in the alleged kidnapping and murder case of a bank branch manager, identified by the initials MIP (32).

“Today’s court agenda involves the reading of prosecution demands from the Military Prosecutor II-07 Jakarta against three defendants,” said Endah Wulandari, spokesperson for the Jakarta Military Court II-08, when confirmed in Jakarta on Monday.

The three defendants—Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3)—are accused of involvement in a series of actions leading to the kidnapping and subsequent murder of MIP.

The hearing was scheduled to take place in the afternoon, around 12:00 WIB, in the Garuda Courtroom, the court’s main chamber.

Another Military Prosecutor, Major (Chk) Wasinton Marpaung, stated that the three soldiers are alleged to have acted together in the kidnapping and murder of the victim, MIP.

For the first defendant, Serka MN, the prosecutor has prepared layered charges. The primary charge involves Article 340 of the Criminal Code (KUHP) in conjunction with Article 55 paragraph (1) 1st of the KUHP, regarding premeditated murder committed jointly. As a secondary charge, MN is also charged under Article 338 in conjunction with Article 55 paragraph (1) 1st of the KUHP, and as a further subsidiary charge under Article 351 paragraph 3 in conjunction with Article 55 paragraph (1) 1st of the KUHP.

Additionally, there is an alternative charge under Article 333 paragraph 3 of the KUHP regarding deprivation of liberty resulting in death. Furthermore, MN faces a cumulative charge under Article 181 of the KUHP related to the alleged concealment of the victim’s body.

Meanwhile, the second defendant, Kopda FH, faces a similar pattern of charges, with Article 340 of the KUHP as the primary charge, supported by Article 338 and Article 351 paragraph 3, as well as an alternative charge under Article 333 paragraph 3 of the KUHP. The third defendant, Serka FY, is charged with a nearly identical legal construction, ranging from premeditated murder to deprivation of liberty resulting in death.
