Proposal for the Establishment of an Agency to Manage Seized Assets from Criminal Proceeds
JAKARTA, KOMPAS.com - Several members of Commission III of the House of Representatives (DPR) have proposed the establishment of a special body to manage assets derived from criminal acts as regulated in the draft Law on Asset Seizure Related to Criminal Acts (RUU Perampasan Aset Terkait Tindak Pidana).
One such proposal came from Commission III member Rikwanto during a public hearing (RDPU) with experts discussing the RUU on Asset Seizure, on Monday (20/4/2026).
“This management requires a separate body that is expert in the field. Should it be included in the Prosecutor’s Office? Or is it possible to propose something outside the Prosecutor’s Office,” said Rikwanto during the RDPU, quoted from the YouTube broadcast of TVR Parlemen, on Monday.
These assets certainly need to be managed properly to avoid any reduction in their value after being seized by the state.
“Do not let it be that when seized, its value is around Rp100 million and becomes state wealth, but over time it drops to Rp1 million due to depreciation and other factors,” said Rikwanto.
The proposal was conveyed by Benny during the public hearing (RDPU) of Commission III with experts and academics discussing the draft Law on Asset Seizure Related to Criminal Acts, on Monday (6/4/2026).
“We need a special body that is professional, independent, and neutral to manage these assets. Not law enforcers managing it,” said Benny during the RDPU.
So far, he has observed that the management of assets from criminal acts seized by the state has not been optimal.
“Our problem is not solely with the regulations, but with the governance of the seized and confiscated assets. After being confiscated, their whereabouts often become unclear,” said Benny.
If it is indeed formed, he hopes that the special body will operate transparently, accountably, and be audited by the Financial Audit Board (BPK).
“The assets must be managed professionally right away. Do not let them be left idle, or their value will decrease or even disappear,” said the Democrat Party politician.
