Pre-trial Motion by Silmy Karim Rejected
The judge has rejected the pre-trial motion filed by former Deputy Minister of Immigration and Correctional Services, Silmy Karim, ruling that the Corruption Eradication Commission’s (KPK) designation of him as a suspect is valid.
“In the merits of the case, the court rejects the pre-trial petition submitted by the Petitioner in its entirety. The Petitioner is ordered to pay the court costs, which amount to zero,” stated the judge during the verdict hearing at the South Jakarta District Court on Tuesday (2/9/2026).
In the considerations, the judge stated that the searches conducted by investigators were accompanied by search warrants, official reports, and notifications to the KPK Supervisory Board. Investigators had also submitted requests for search approval to the Chief of the District Court.
“Considering that the Respondent’s search was accompanied by a search warrant, an official report was produced, approval was obtained from the District Court, and notification was provided to the KPK Supervisory Board,” the judge explained.
The judge also noted that the scope of a pre-trial motion only pertains to the actions of investigators and does not extend to the actions of parties providing approval, such as the Chief of the District Court. The judge stated that the KPK investigators had fulfilled their obligations as prescribed by law.
“Factually, approval for the search was issued by the Chief of the Court; therefore, the search must be declared valid,” he added.
The judge further stated that the seizures conducted by investigators were based on warrants, documented in official reports, and reported to the KPK Supervisory Board, thus rendering the seizures valid.
Previously, Silmy Karim filed a pre-trial lawsuit against the KPK, requesting that his designation as a suspect and the seizure of assets by the KPK be declared invalid.
“The Petitioner requests the Chief of the South Jakarta District Court, through the presiding judge, to examine, decide, and adjudicate this case with the following verdict: to accept and grant the Petitioner’s pre-trial motion in its entirety,” said Silmy Karim’s lawyer, Agus Sudjadtmoko, during the hearing at the South Jakarta District Court on Monday (21/9).
Silmy Karim challenged 15 documents issued by the KPK against him, including investigation orders (sprindik) dated 3 June 2026.
For context, the KPK has named eight individuals as suspects in a case involving alleged extortion related to limited stay permits for foreign nationals (WNA). The KPK has also seized assets with a total value of approximately Rp 150 billion in this case.
“As of today, the team has seized several assets, recorded at approximately Rp 150 billion, consisting of movable and immovable assets, including vehicles, land, and buildings,” said the Acting Director of Investigation at the KPK, Achmad Taufik Husein, during a press conference on Wednesday (19/8).
The extortion case regarding limited stay permits for foreign nationals allegedly occurred since Silmy Karim served as the Director General of Immigration in 2023. The KPK suspects the total funds collected in this case reach Rp 145.5 billion, with allegations that Silmy received a weekly share of Rp 100 million.
