Pre-trial Hearing: Silmy Karim Requests Cancellation of KPK Suspect Status
The former Deputy Minister of Immigration and Correctional Services (Imipas), Silmy Karim, has filed a pre-trial lawsuit against the Corruption Eradication Commission (KPK). Silmy is requesting that his designation as a suspect and the seizure of assets by the KPK be declared invalid.
“The Petitioner requests the Chairperson of the South Jakarta District Court, through the presiding judge, to examine, decide, and adjudicate this case with a verdict to accept and grant the pre-lar trial petition in its entirety,” stated Silmy Karim’s lawyer, Agus Sudrajat, during a hearing at the South Jakarta District Court on Monday (21/09/2026).
Silmy Karim is challenging 15 documents issued by the KPK against him. These include investigation orders (sprindik) numbered Sprin.Dik/27/DIK.00/01/06/2026 and Sprin.Dik/27.1/DIK.00/01/06/2026, both dated 3 June 2026, as well as the KPK Leadership Decree Number 917.1 of 2026 regarding the designation of suspects.
Furthermore, Silmy is contesting the notification of suspect designation, detention orders, detention notifications, and the official reports regarding his detention at the KPK Detention Centre. He is also challenging seizure reports dated 3 June 2026, document deposit receipts, search reports, and seizure reports from a search conducted at Jl Balitung I, Kebayoran Baru, South Jakarta, on 5 June 2026.
“These are invalid, not based on law, and have no binding legal force,” he stated.
He specifically questioned the two investigation orders dated 3 June 2026, arguing they lack legal basis and requesting the judge to order the KPK to cease the investigation. He also requested that the judge order his release from detention immediately upon the verdict and demand that the KPK return all seized evidence.
The petitioner’s demands (petitum) include:
Accepting and granting the pre-trial petition in its entirety.
Declaring the investigation orders, suspect designation, detention, searches, and seizures as invalid and legally non-binding.
Ordering the KPK to halt the investigation against the Petitioner.
Declaring the alleged corruption involving extortion related to foreign national residence permits within the Ministry of Immigration and Correctional Services (2021–2026) as invalid.
Ordering the immediate release of the Petitioner from the detention centre.
Ordering the KPK to return all seized evidence to the original owners.
Restoring all legal rights of the Petitioner.
For information, the KPK has named eight individuals as suspects in this alleged extortion case involving foreign national (WNA) residence permits.
