Pramono affirms Jakarta's continued status as capital city
Jakarta (ANTARA) - Governor of DKI Jakarta Pramono Anung Wibowo has emphasised that Jakarta retains its status as the capital until a presidential decree (Keppres) is issued.
This was stated by Pramono in response to the Constitutional Court (MK) ruling that rejected in its entirety the petition for judicial review of Law No. 3 of 2022 on the State Capital (UU IKN).
“Regarding the Constitutional Court’s decision related to DKI Jakarta remaining the capital, I fully understand and know that as long as there is no presidential decision on the relocation, the capital is in DKI Jakarta,” Pramono explained at Jakarta City Hall on Wednesday.
According to him, the provincial government (Pemprov) of DKI Jakarta is still implementing the MK’s decision. They continue to refer to it as the Special Capital Region (DKI) and not the Special Jakarta Region (DKJ).
“Up to today, all activities in DKI Jakarta still use the DKI designation until a presidential decision on the capital relocation is issued. With the MK’s decision, this serves as further affirmation of that,” Pramono said.
The pronouncement of Decision No. 71/PUU-XXIV/2026 was led by MK Chief Justice Suhartoyo in the Plenary Courtroom, Building 1 of the MK, on Tuesday (12/5/2026).
“The petition of the petitioner is rejected in its entirety,” stated Suhartoyo.
The MK stressed that Jakarta still holds the status of Indonesia’s capital city.
In its legal considerations, the MK interpreted Article 2 paragraph (1) of Law No. 2 of 2024 on the Special Jakarta Province (DKJ) as needing to be read and understood in connection with the norm in Article 73 of the UU DKJ.
“This law shall come into effect upon the issuance of a Presidential Decree regarding the relocation of the Capital of the Unitary Republic of Indonesia from the Special Capital Province of Jakarta to the Nusantara Capital,” reads Article 73 of the UU DKJ.
MK Justice Adies Kadir explained that the meaning of “come into effect” in Article 73 of Law 2/2024 binds the substance/material of the capital relocation norm, when the Keppres on relocating the capital from Jakarta to the Nusantara Capital (IKN) is issued by the President.
This status applies as long as the Presidential Decree (Keppres) for relocating the capital from Jakarta to IKN has not been issued.
