Prabowo Issues Presidential Regulation on Allowances for Ad Hoc Judges
Jakarta (ANTARA) - President Prabowo Subianto has issued Presidential Regulation (Perpres) No. 5 of 2026 on the Financial Rights and Facilities of Ad Hoc Judges, promulgated on 4 February 2026, to strengthen the quality of judicial administration in Indonesia.
A copy of the Perpres cited in Jakarta on Monday states that regulating the financial rights and facilities for ad hoc judges is necessary because they exercise judicial authority, requiring integrated regulation within the legal system.
The issuance of this new regulation also aims to improve judicial quality through support for integrity, professional, and independent ad hoc judges in carrying out their duties.
Perpres No. 5 of 2026 simultaneously replaces several previous provisions related to the financial rights and facilities of ad hoc judges, which had undergone multiple amendments, including regulations on honouraria for ad hoc judges.
Key points of the Perpres include that every Ad Hoc Judge is entitled to a monthly allowance, the amount of which includes income tax.
In addition to the allowance, the state provides facilities such as state housing and transportation in the assignment area, health insurance and security guarantees during duty, and official travel expenses (transportation and accommodation) equivalent to those of judges at the assigned court.
Furthermore, the Perpres highlights the provision of an appreciation payment at the end of the term, equivalent to two times the allowance amount.
For judges who do not complete their full term, the appreciation payment is given proportionally based on the period of service.
The Perpres No. 5/2026 also regulates provisions for Ad Hoc Judges from civil servant/TNI/Police elements. Ad Hoc Judges originating from civil servants, TNI soldiers, or Police members are not entitled to receive income from their original institutions while receiving allowances as Ad Hoc Judges.
Regarding discipline enforcement, the appreciation payment will not be given to Ad Hoc Judges who are dishonourably dismissed due to severe administrative sanctions or sentenced to imprisonment based on a court decision with final legal force.
The Perpres also emphasises that Ad Hoc Judges who resign or are dismissed from their positions do not receive pension rights or severance pay.
With this regulation coming into effect from the date of promulgation, namely 4 February 2026, it is hoped that the judicial system in specialised courts, from first instance, appeal, to cassation levels, can operate more optimally and accountably.
