Police: RJ and Diversion are Methods of Case Resolution Outside Court
Restorative justice (RJ) and diversion are methods of case resolution outside the court, not case termination, and are implemented in accordance with the new Criminal Procedure Code (KUHAP) that prioritises the principle of justice.
Mataram (ANTARA) - The West Nusa Tenggara Regional Police (Polda NTB) states that the application of restorative justice (RJ) and diversion in handling cases is a method of resolution outside the court that prioritises the principle of justice.
Officer of Subdirectorate III Unit of Criminal Investigation for the Protection of Women and Children and Eradication of Human Trafficking (PPA-PPO) of Polda NTB, Luk Luk Il Maqnun, in Mataram on Tuesday, said that the application of these methods refers to Law Number 20 of 2025 on the Criminal Procedure Code.
“RJ and diversion are methods of case resolution outside the court, not case termination, and are implemented in accordance with the new KUHAP that prioritises the principle of justice,” said Luk Luk.
She gave an example of the application of RJ in a prostitution case from Operation Pekat Rinjani 2026 handled by Subdit III Criminal Investigation PPA-PPO Polda NTB. In that case, investigators determined two suspects, namely R (24) and RA (32).
Investigators applied Article 420 of Law Number 1 of 2023 on the Criminal Code, which placed both as pimps.
In addition, other considerations are that the suspects are not recidivists, it is their first involvement, and the criminal threat is under five years.
Meanwhile, the diversion method is applied to perpetrators who are still minors.
Acting Head of Subdit I Panit Criminal Investigation PPA-PPO Polda NTB Dewi Sartika said that diversion only applies to perpetrators under 18 years of age or children in conflict with the law.
“Perpetrators under 18 years are not called suspects, but children in conflict with the law,” she said.
She added that the application of diversion must also meet formal and material requirements, including not being recidivists and a criminal threat under seven years.
Polda NTB applied diversion in another prostitution case involving a child with initials M (17).
In the diversion process, the police conduct deliberations with various parties, such as the Community Guidance Institution (Bapas), social workers, and the perpetrator’s parents.
Dewi explained that the results of the deliberation will determine the follow-up, whether the perpetrator is returned to parents with environmental supervision or undergoes guidance at a social institution.
“If undergoing guidance, the perpetrator can obtain rights to education and skills training during the guidance period,” she said.
