Polda Metro Responds to Judge's Decision Rejecting Roy Suryo's Pretrial Motion
Polda Metro Jaya has spoken out regarding the decision of the South Jakarta District Court judge who rejected Roy Suryo’s pretrial motion to test the legality of the coercive measure banning him from travelling abroad.
Head of Legal Affairs of Polda Metro Jaya, Commissioner Abrianto Pardede, said that Polda Metro Jaya respects the judge’s decision as part of the applicable legal process.
“Polda Metro Jaya respects the judge’s decision which rejected all of the petitioner’s pretrial requests. We will continue to follow every legal process in accordance with statutory regulations,” said Abrianto in his statement on Wednesday (26/8).
Abrianto said that his party is also ready to face the fifth pretrial lawsuit that Roy Suryo has filed with the South Jakarta District Court. He said that his party respects the right of every party to pursue legal mechanisms in accordance with applicable provisions.
Abrianto said that Polda Metro Jaya will study the material of the petition and prepare legal steps after receiving an official summons from the court.
“Polda Metro Jaya is also ready to follow the process professionally while continuing to respect the independence of the court in examining and deciding cases,” he said.
Previously, the sole judge of the South Jakarta District Court, I Ketut Darpawan, rejected the pretrial motion of KMRT Roy Suryo which tested the legality of the coercive measure banning him from travelling abroad by Polda Metro Jaya.
“Adjudicating, rejecting the petitioner’s pretrial motion in its entirety,” said the judge when reading the verdict at the South Jakarta District Court on Wednesday (26/8).
The judge stated that the main case regarding the alleged accusation of a fake diploma of the 7th President of the Republic of Indonesia Joko Widodo which ensnared Roy has been transferred to court, so the pretrial motion is no longer relevant.
Based on the provisions of Article 163 paragraph 1 letter e of the Criminal Procedure Code, the judge explained, a pretrial motion can only delay the commencement of the examination of the main case if the main case is transferred while the pretrial process is ongoing.
The judge said that Roy deliberately filed pretrial motions one by one after the main case entered the court. The judge considered this action as a form of abuse of legal procedure.
