Polda Metro Jaya Responds to Roy Suryo's Successful Pretrial Motion

The Head of Legal Affairs for Polda Metro Jaya, Senior Commissioner Abrianto Pardede, has responded to the South Jakarta District Court’s decision to partially grant Roy Suryo’s pretrial motion regarding the case of alleged fake news about President Joko Widodo’s diploma. Abrianto stated that he respects the decision of sole judge I Ketut Darpawan, which declared the search and detention of Roy Suryo unlawful. However, he emphasised that the ruling does not halt or invalidate the main investigation process currently underway. “The judge’s decision partially granted the applicant’s lawsuit. Let us both respect that decision. However, the investigation conducted by investigators is not automatically rendered invalid. This means the investigation remains in effect,” Abrianto said when contacted on Tuesday (7/7/2026). Abrianto noted that the handling of the legal case against Roy Suryo has now progressed to the next phase. The case file, along with all supporting evidence from investigators, has been declared complete and officially transferred to the prosecution service through the second-stage handover mechanism. “The case file, evidence, and other materials have been handed over to the prosecutor’s office at stage two. It will be continued by the public prosecutor for the next process,” he stated. With the transfer of the file and detention authority to the public prosecutor, Polda Metro Jaya confirmed that the prosecution in court will be fully under the purview of the prosecutor’s office. This clarification underscores that Roy Suryo’s partial victory in the pretrial hearing only corrected administrative procedures regarding the arrest and detention, but did not nullify the criminal charges against him. Previously, sole judge I Ketut Darpawan at the South Jakarta District Court partially granted the pretrial motion filed by former Youth and Sports Minister Roy Suryo. Roy Suryo had been named a suspect by Polda Metro Jaya for allegedly spreading false news regarding the diploma of the 7th President of Indonesia, Joko Widodo. In the verdict reading, Judge I Ketut Darpawan found a clear procedural error in the search conducted by the investigation team at Roy Suryo’s residence on 19 June 2026. The judge explained that the search warrant from the Tangerang District Court was specifically granted to locate evidence believed to be inside the applicant’s house. However, the execution of the warrant was diverted to arrest Roy Suryo for the purpose of a second-stage transfer to the prosecutor’s office after the case file was declared complete (P21). “It was no longer for the purpose of finding and seizing evidence,” the judge stated in the South Jakarta District Court courtroom on Tuesday (7/7/2026).
