Polda Metro Jaya Respects Court's Rejection of Roy Suryo's Second Pretrial Motion

Polda Metro Jaya has responded to the South Jakarta District Court’s decision to reject the second pretrial motion filed by Roy Suryo concerning an alleged violation of the Electronic Information and Transactions Law (UU ITE). The police force stated it respects the judge’s ruling.

Polda Metro Jaya’s Head of Legal Affairs, Senior Commissioner Abrianto Pardede, said the judge’s decision serves as a basis for all parties to respect and carry out the ongoing legal process. ‘We respect the judge’s decision which firmly rejected Roy Suryo’s second pretrial motion. In its considerations, the court stated that the material submitted is no longer relevant,’ Senior Commissioner Abrianto said in a statement on Monday (20/7/2026).

Senior Commissioner Abrianto explained that in the ruling, the judge also considered the pretrial motion filed by the applicant to be no longer relevant, as it was deemed an attempt to delay the examination of the main case. ‘The judge has considered that the motion was deemed a delaying tactic. Therefore, we are obliged to respect and implement the judge’s decision in accordance with legal provisions,’ he said.

Nevertheless, Senior Commissioner Abrianto emphasised that a pretrial motion is a legal right of every citizen. Any party who feels aggrieved in a legal process has the right to pursue a pretrial mechanism in accordance with statutory regulations. ‘A pretrial motion is the right of every citizen who feels legally aggrieved. Please file it according to the applicable mechanism. However, in this case, the judge has decided that the motion is no longer relevant,’ he clarified.

Senior Commissioner Abrianto stated that following the second pretrial ruling, the examination of the main case will continue according to the trial schedule. Polda Metro Jaya has assured it will follow all applicable legal stages. ‘The main case will proceed. We will attend and follow the trial process in accordance with legal provisions,’ he said.

Senior Commissioner Abrianto also conveyed that should there be further pretrial motions in the future, Polda Metro Jaya remains ready to face the process professionally. ‘If there is another pretrial motion, we will still attend to face it. In principle, we respect the entire legal process,’ said Senior Commissioner Abrianto.

The South Jakarta District Court rejected all of Roy Suryo’s second pretrial motion. The judge assessed that the motion was no longer relevant because the main case has already entered the court, and the trial forum for the main case is considered a more appropriate venue to examine the charges and evidence.
