Polda Metro Jaya has announced it is preparing its response as the respondent in a pretrial hearing filed by Roy Suryo at the South Jakarta District Court. The hearing is scheduled to continue with the agenda of the respondent’s answer on Tuesday (30/6). ‘We are currently preparing the answer for the pretrial motion. We respect the legal process and it is the right of a suspect to file a pretrial motion,’ said Polda Metro Jaya Head of Public Relations, Commissioner Budi Hermanto, on Monday (29/6).

Director of Criminal Investigation for Polda Metro Jaya, Commissioner Iman Imanuddin, stated that his team is ready to face the pretrial and will demonstrate that all law enforcement actions were carried out according to procedure. ‘We will show that the entire series of law enforcement processes carried out by our investigators were in accordance with the Standard Operating Procedures (SOP) and the Criminal Procedure Code (KUHAP),’ Iman said.

Roy Suryo, a former minister, filed the pretrial motion to challenge the legality of the search and arrest conducted by Polda Metro Jaya investigators. He was named a suspect in a case related to a meme that allegedly defamed President Joko Widodo by questioning the authenticity of the president’s diploma. In his petition, Roy’s legal team requested that the judge declare the search of his house and his subsequent arrest unlawful. They argued that the search was not based on a valid warrant from the head of the local district court and that the arrest violated several articles of the Criminal Procedure Code and the 1945 Constitution, thereby breaching the principle of legal certainty.
