The Jakarta State Administrative Court (PTUN) has officially rejected a lawsuit filed by the Perkumpulan Lyceum Kristen (PLK) against the Directorate General of General Legal Administration (Ditjen AHU) of the Ministry of Law. In a ruling announced electronically on Wednesday (8/7), the panel of judges declared the lawsuit inadmissible, or Niet Ontvankelijk Verklaard (NO).

The object of dispute in this case was the Decree of the Minister of Law of the Republic of Indonesia Number: AHU-08.AH.01.43 of 2025 concerning the Revocation of the Decree of the Minister of Law and Human Rights Number: AHU-0000204.AH.01.08 of 2017, dated 28 August 2025. The decree cancelled the approval for changes to PLK’s legal entity status.

The panel of judges assessed that the issuance of the revocation decree was based on a court decision that had permanent legal force. Therefore, the object of dispute falls into the category of Excluded State Administrative Decisions as stipulated in Article 2 letter (e) of Law Number 9 of 2004 concerning State Administrative Courts.

This ruling is a crucial victory for the West Java Provincial Government in its efforts to protect state assets. The Head of the Legal Entity Advocacy Working Team at the Directorate General of General Legal Administration of the Ministry of Law, Fitra Kadarina, welcomed the decision. “We are very pleased with this PTUN ruling. This means the state’s authority to protect its assets is stronger against the threat from PLK,” Fitra said in a written statement on Saturday (11/7).

Fitra explained that, based on official data from the Ministry of Law, the plaintiff organisation actually lacks valid legality because it was dissolved by the government in 1984. Thus, the legal standing used by PLK during the trial was considered to lack a strong basis.

In its considerations, the Administrative Court stated that the defendant’s (Ministry of Law) step was correct in using the Bandung District Court Criminal Decision Number: 811/Pid.B/2017/PN.Bdg as one of the bases for issuing the object of dispute. This was also reinforced by the Bandung District Court Civil Decision Number: 228/Pdt.G/2022/PN.Bdg.

This lawsuit was the aftermath of PLK’s defeat in a land dispute over SMAN 1 Bandung against the West Java Provincial Government. At the previous appeal level, the West Java Provincial Government won the land ownership case. West Java Governor Dedi Mulyadi had also previously lodged a formal objection regarding PLK’s legal standing. The objection was based on findings of document forgery, so the Ministry of Law’s move to revoke the organisation’s legal entity status in 2025 was deemed to be in accordance with applicable legal procedures.
