Peradi SAI: Legal Certainty Supports Economic Growth
The Indonesian Advocates Association Suara Advokat Indonesia (Peradi SAI) assesses that the development of government policy in the legal and economic fields is showing an increasingly positive direction, especially in efforts to create legal certainty for the business world. This view emerged at the Indonesia Legal Economic Forum (ILEF) 2026, which brought together law enforcement officials, business actors, and advocates to discuss the implementation of the National Criminal Code (KUHP), particularly regarding corporate criminal liability, in Jakarta on Thursday. Peradi SAI Chairman Harry Ponto stated that the improving direction of development will provide certainty for business actors in carrying out their activities. ‘Looking at the developments, it is clear that Indonesia is heading in a good direction. Business people must be orderly, and companies must also be orderly. There is no more excuse of not knowing,’ Ponto said. According to him, the holding of ILEF 2026 coincides with six months since the KUHP came into force. Ponto noted that since the KUHP was enacted, many business actors have questioned the provisions regarding corporate criminal liability. Under the new rules, a corporation can be held accountable if it is involved in a criminal act. To address this, Peradi SAI presented speakers from various backgrounds, including the police, prosecutors, the judiciary, advocates, and business actors. ‘What we are doing now is looking at the implementation of the KUHP from the perspectives of the police, prosecutors, and judges. Because its implementation is only six months old, this forum is important to broaden our insights,’ he said. The forum also discussed legal developments related to corporate criminal liability, including efforts by law enforcement to trace the beneficial owner of a criminal act. Ponto emphasised that this forum also provides understanding to business actors to strengthen supervision of their company’s activities. According to him, parties who should have known about a violation but allowed it to happen can also be held legally accountable. Meanwhile, Peradi SAI Secretary General Patra M. Zen said that before the KUHP came into effect, corporate criminal liability was generally applied to specific crimes such as corruption, money laundering, and environmental crimes. He said ILEF 2026 serves as a platform for business actors and legal practitioners to understand regulatory developments and hear directly the views of stakeholders. The forum featured Supreme Court Justice for Criminal Cases Prof. Surya Jaya, Senior Public Prosecutor Erni Mustikasari, and the National Police’s Director of Investigation Supervision Brigadier General Boy Rando Simanjuntak. BPI Danantara Chief Investment Officer Sofyan A. Djalil was also present as a keynote speaker. The organising committee stated that the forum is expected to clarify the relationship between the government’s efforts to drive economic growth and the assurance of law enforcement.
