Peradi Otto Sued Again, This Time at East Jakarta District Court

The National Leadership Council (DPN) of Peradi, led by Deputy Coordinating Minister for Law, Human Rights, Immigration, and Corrections Otto Hasibuan, has been sued again for alleged unlawful acts (PMH) at the East Jakarta District Court.

The lawsuit was filed by an advocate from Jambi, Bayu Anugerah, through his legal counsel from the Irfan Maulana & Partners Advocate Office. The case was officially registered on Wednesday, 17 June 2026, based on the provisions of Article 1365 of the Civil Code.

Not only was Otto Hasibuan named as Defendant I, but the President of the Republic of Indonesia, as head of the executive branch, was also named as Defendant II. The Head of State is considered to have committed omission and negligence in the supervisory function over ministers and deputy ministers under his mandate.

The Plaintiff’s legal counsel, Irfan Maulana Muharam, stated that this legal action was forced upon them because Otto Hasibuan is considered to have openly committed legal defiance.

“Defendant I is known to remain active in his position and control the National Leadership Council of the Indonesian Advocates Association (DPN PERADI) as General Chair, despite having held the status of State Official since being inaugurated by the President on 21 October 2024,” he explained.

This concurrent holding of positions is deemed to have clearly violated three rulings of the Constitutional Court (MK) which are final and universally binding (erga omnes), namely:

Constitutional Court Decision Number 91/PUU-XX/2022: Stipulates strict limitations on the term of office for leaders of advocate organisations to a maximum of 2 periods (10 years). On the other hand, Otto Hasibuan is recorded as having led PERADI for three periods, namely 2005–2010, 2010–2015, and again from 2020–2025.

Constitutional Court Decision Number 183/PUU-XXII/2024: Obliges leaders of advocate organisations to immediately step down from their organisational positions if appointed or designated as state officials.

And Constitutional Court Decision Number 128/PUU-XXIII/2025 in conjunction with the Law on State Ministries: Strictly prohibits ministers and deputy ministers from concurrently holding positions as leaders of organisations that receive funding streams from the state budget (APBN) or regional budget (APBD). As a note, the Legal Aid Centre (PBH) unit of PERADI regularly manages pro bono legal aid funds sourced from the state budget.
