Professor Ing Mokoginta from North Sulawesi, accompanied by the legal team from the PDI Perjuangan’s (PDIP) Badan Bantuan Hukum dan Advokasi Rakyat (BBHAR), visited the National Police Criminal Investigation Department (Bareskrim) in Jakarta on Thursday, 9 July, to question the progress of an alleged land mafia case that has been ongoing since 2017.

Wiradarma Harefa, a member of the BBHAR PDIP legal team, stated that the visit aimed to seek certainty regarding the case currently handled by the Directorate of General Crimes (Dittipidum) at Bareskrim. “Today we are accompanying Prof. Ing to inquire about the progress of this case. This report has been active since 2017, and there has been no clear resolution. Prof. Ing is still seeking justice regarding the land that fell victim to a land mafia in North Sulawesi,” said Wiradarma.

He explained that the team brought two agendas to Bareskrim. The first was to question the development of the criminal report that has been ongoing for years. The second was to consult on plans to file a new police report against the parties currently occupying the family’s land.

Wiradarma elaborated that the team is considering filing a new report because the individuals currently occupying the land no longer have a legal basis to do so. According to him, the land title certificate (SHM) that previously served as the basis for the occupation has been revoked based on the Manado State Administrative Court (PTUN) Decision Number 40/G/2017/PTUN.MDO, which has permanent legal force.

This ruling, Wiradarma continued, was followed up by the Kotamobagu City National Land Agency (BPN) and the North Sulawesi Regional BPN Office, which subsequently revoked the SHM issued in the name of the opposing party. “We are consulting on filing a police report against the people currently occupying the land, as they no longer have a legal basis to reside there after their certificate was annulled by a legally binding PTUN decision and revoked by both the Kotamobagu City BPN and the North Sulawesi Regional BPN Office,” he stated.

Wiradarma noted that the family had previously filed four criminal reports with the North Sulawesi Regional Police regarding the alleged land seizure. Currently, only one of these reports is still being processed, and its handling has been escalated to Bareskrim.
