PDI-P Says Proposal for DPRD Parliamentary Threshold Requires Thorough Study, Fears Annulment by Constitutional Court
JAKARTA - PDI-P’s Central Executive Board Chairman Deddy Sitorus has reminded that the proposal to apply a tiered parliamentary threshold from the DPR RI to the DPRD level must be studied thoroughly and comprehensively.
The Member of DPR RI Commission II assessed that without a strong basis, the policy could potentially be challenged and annulled by the Constitutional Court (MK).
“It’s a proposal, so go ahead, just study the advantages and disadvantages. If it’s for the effectiveness of legislation at the local level, there are indeed benefits, potentially making decision-making easier. But of course, there are also drawbacks that need to be considered,” said Deddy on Friday (24/4/2026).
“Don’t let it become vulnerable to lawsuits at the MK because nowadays MK decisions tend to be unpredictable and cause confusion. We go through all the trouble to discuss it, then the MK rules the opposite,” he said.
Personally, Deddy admitted to having the view that the MK should be involved, or given space to provide input in the midst of the legislative process.
“Sometimes I think, should the MK just participate in providing analysis during the law-making process or be asked for a fatwa before a law is enacted. Why go through all the trouble if anyone’s arguments can negate a long political process,” Deddy revealed.
“The MK should only be authorised to say whether something is constitutional or not, not to lock in articles or new norms as if the MK has the authority to make laws,” he concluded.
Previously, the Golkar Party proposed a parliamentary threshold for DPRD legislative elections of 4 percent at the provincial level and 3 percent at the district/city level in the revision of the Election Law.
“For example, 5, 4, 3. Five percent for DPR RI, four percent for provincial DPRD, and three percent for district/city DPRD,” said Doli.
According to Doli, the scheme is designed to create a balance between people’s representation and governmental effectiveness.
NasDem Party’s Central Executive Board Chairman and DPR RI Commission II Chairman, Rifqinizamy Karsayuda, stated that the policy is important to strengthen the party system and governmental effectiveness.
“We propose that the parliamentary threshold applies not only at the national level, but also at the provincial, district, and city levels,” said Rifqinizamy.
