The Financial Services Authority (OJK) has issued two Financial Services Authority Regulations (POJK) regarding the Mineral and Strategic Commodities Exchange (BMKS). The transfer of authority from Bappebti to OJK will take effect on 1 January 2027, when the BMKS begins operations.

The two regulations include, firstly, POJK Number 15 of 2026, concerning the phased transition of the duties and authority for regulating and supervising transactions at the Mineral and Strategic Commodities Exchange from the Commodity Futures Trading Regulatory Agency (Bappebti) to the Financial Services Authority (OJK). Secondly, POJK Number 16 of 2026 concerns the Implementation of the Mineral and Strategic Commodities Exchange.

Furthermore, OJK has set a minimum paid-up capital of Rp 1 trillion for the operation of the BMKS. This provision is stated in Article 9 of OJK Regulation (POXB) Number 16 of 2026 regarding the Implementation of the Mineral and Strategic Commodities Exchange.

“The Exchange’s paid-up capital must be at least Rp 1,000,000,000,000 (one trillion rupiah),” the POJK stated in an official announcement on Monday (21/9/2026).

OJK has also established minimum paid-up capital requirements for institutions supporting the BMKS operations. According to the regulations in Article 28, Clearing Institutions (LK) must have a minimum paid-up capital of at least Rp 500 billion. Additionally, Electronic Custodian Institutions (LKE) are also required to have a minimum paid-up capital of at least Rp 500 billion.

The issuance of these two POJKs is an initial step by OJK in fulfilling the mandate of Article 132A of Law Number 4 of 2026 regarding the Amendment to Law Number 4 of 2023 on the Development and Strengthening of the Financial Sector (P2SK Law Amendment), which mandates OJK to carry out the regulation and supervision of transactions at the Mineral and Strategic Commodities Exchange (BMKS).

“The regulation of the Mineral and Strategic Commodities Exchange is intended to build market infrastructure capable of conducting trade in Strategic Minerals and Strategic Commodities in an orderly, fair, transparent, efficient, and integral manner, as well as providing certainty regarding the price formation process, clearing, transaction settlement, and risk management,” wrote OJK.

It was noted that POJK Number 15 of 2026 aims to ensure a smooth and measurable transition to maintain market stability, prevent legal vacuums, and minimise operational obstacles for existing business players.

Meanwhile, POJK Number 16 of 2026 aims to strengthen the regulatory and supervisory framework for the implementation of the BMKS, regulating aspects such as trading participants, trading procedures, transaction implementation, governance, risk management, user protection, and integrity enforcement.

“The implementation of the BMKS is designed as a unified ecosystem that integrates the functions of trading, clearing, guaranteeing, transaction settlement, up to the management of Electronic Proof of Ownership,” the announcement stated.

OJK emphasised that the BMKS must adhere to the principles of order, fairness, transparency, efficiency, certainty of transaction settlement, market integrity, and risk management.

The POJK also includes aspects of user protection aimed at increasing confidence in the BMKS operations and protecting the interests of service users.

With the issuance of these two POJKs, OJK hopes the BMKS ecosystem can grow in a healthier, more professional, and more competitive manner, creating a liquid and trusted market to support increased investor confidence in the Indonesian financial services industry.

Financial Services Authority Regulation Number 15 of 2026 came into effect on 17 September 2026, while Financial Services Authority Regulation Number 16 of 2026 will take effect on 1 January 2027.
