Oil Corruption: Former Pertamina Patra Niaga CEO Sentenced to 6 Years in Prison
Jakarta (ANTARA) - The CEO of PT Pertamina Patra Niaga (PPN) from 2021 to 2023, Alfian Nasution, has been sentenced to six years’ imprisonment after being found guilty of involvement in an alleged corruption case regarding the governance of crude oil and refinery products at PT Pertamina (Persero) from 2013 to 2024.
“The defendant Alfian Nasution is proven legally and convincingly guilty of committing the criminal act of corruption jointly as per the primary indictment of the public prosecutor,” said Chief Judge Adek Nurhadi during the verdict hearing at the Corruption Court of the Central Jakarta District Court on Tuesday.
The Chief Judge stated that Alfian, along with the other defendants, was proven legally and convincingly guilty of jointly committing the criminal act of corruption, causing state financial losses of US$2.73 billion and Rp25.44 trillion.
Both were also imposed with fines of Rp1 billion each, with a subsidiary penalty of imprisonment for 160 days if the fine is not paid.
The judge explained that the defendants’ actions were carried out in three stages: the procurement of fuel terminal leasing by Pertamina, the provision of compensation for special assignment fuel (JBKP) RON 90 in 2022–2023, and the sale of non-subsidised diesel in 2020–2021.
In the judges’ considerations, the defendants’ actions included, among others, requesting direct appointment to PT Oiltanking Merak (OTM) for fuel terminal leasing cooperation, even though it did not meet procurement criteria.
Before handing down the verdict, the Panel of Judges considered aggravating and mitigating factors. The aggravating factor was that Alfian and Hanung’s actions did not support the government’s ongoing campaign to eradicate corruption.
“Meanwhile, the mitigating factors are that the defendants were cooperative in court, have family dependents, have no prior convictions, and are of advanced age,” said the Chief Judge.
After considering these various factors, the Panel of Judges’ verdict was lighter than the prosecutors’ demand. Previously, Alfian and Hanung were each demanded 14 years and 8 years in prison, a fine of Rp1 billion with a subsidiary penalty of 190 days in prison, and restitution of Rp5 billion with subsidiary penalties of 7 years and 4 years in prison.
In the alleged crude oil corruption case, Alfian and Hanung were charged with unlawful acts jointly with the Director of Gas, Petrochemicals, and New Business at PT Pertamina International Shipping (PIS) from 2024 to 2025, Arief Sukmara, along with the Vice President (VP) of Crude, Product Trading, and Commercial (CPTC) Integrated Supply Chain (ISC) at PT Pertamina (Persero) from 2019 to 2020, Dwi Sudarsono.
Then, Business Development Manager of Trafigura Pte, Ltd from 2019 to 2021, Martin Haendra Nata, Business Development Manager of PT Mahameru Kencana Abadi, Indra Putra, Director of Marketing Centre and Trading at Pertamina Patra Niaga from 2020 to 2021, Hasto Wibowo, and Senior Vice President (SVP) of ISC Pertamina from 2017 to 2018, Toto Nugroho.
The verdicts for the six defendants were read separately after the verdict reading session for Alfian and Hanung.
