Observer Urges Public to Scrutinise Asset Forfeiture Bill Discussions
Jakarta (ANTARA) - Legal and development observer Hardjuno Wiwoho has urged the public to closely monitor the progress of the discussions regarding the Asset Forfeiture Bill, based on accountable information, to avoid being influenced by narratives that do not align with the legislative process.
In a statement in Jakarta on Friday, Hardjuno noted that, according to information available to him, the discussion of the Bill is currently in the drafting and harmonisation stage within Commission III of the House of Representatives (DPR RI).
“Based on the progress of discussions in Commission III of the DPR RI, the Asset Forfeiture Bill is still in the process of drafting and harmonisation,” he said.
He argued that public attention should be directed towards overseeing the discussions to ensure they are conducted openly and accountably, resulting in effective regulations that simultaneously guarantee legal certainty.
According to Hardjuno, caution in aligning the Bill with the Criminal Code (KUHP), the Criminal Procedure Code (KUHAP), the principle of “due process of law”, the protection of human rights, and the rights of third parties acting in good faith is a vital component of the regulatory drafting process.
Due process of law is a legal principle ensuring that every individual is entitled to fair treatment, protection of human rights, and a valid judicial process. This principle prevents arbitrary actions by law enforcement agencies or the government.
He also assessed that the strengthening of asset forfeiture mechanisms must remain balanced with legal certainty and the protection of citizens’ rights.
Meanwhile, Commission III of the DPR RI stated that the discussion of the Asset Forfeiture Bill will continue during the recess period through the absorption of aspirations in various regions.
The Chairman of Commission III of the DPR RI, Habiburokhman, stated that the drafting of the Bill is being conducted in an open and participatory manner, involving various stakeholders to produce a comprehensive and implementable regulation.
