Observer: Implementation of DKI Jakarta's Smoke-Free Zone Regulation Must Be Handled with Care

Public policy observer from Trisakti University, Trubus Rahadiansyah, has emphasised the importance of exercising caution in implementing DKI Jakarta Provincial Regulation (Perda) Number 7 of 2025 concerning Smoke-Free Zones (Kawasan Tanpa Rokok/KTR).

Trubus conveyed his views in Jakarta on Friday (20/2), highlighting the social and economic dynamics that accompany the regulation's implementation.

He warned that the KTR regulation does not merely govern designated smoking areas but also extends to the regulation of cigarette sales by traders — a provision that, in his assessment, has the potential to trigger public resistance if not implemented wisely.

"Expanding the rules to include sales arrangements for small traders, market vendors and mobile sellers could provoke significant public pushback," Trubus said.

He stressed the need for the policy to be carefully considered so as not to negatively affect the economy and business continuity, particularly for small and medium enterprises (UMKM).

Trubus recommended that enforcement be firm yet more limited in scope — for instance, focusing on places of worship, healthcare facilities such as hospitals, and educational institutions — without extending to traditional markets or small-scale economic spaces.

On the matter of tobacco advertising, he suggested it should be permitted but with regulated placement, thereby creating a balance between public health objectives and economic sustainability.

"Implementation of this Perda must not be overly rigid. It must be able to find a balance point that produces a win-win solution for all stakeholders," Trubus said.

He further noted that policies such as the Smoke-Free Zone regulation should be accompanied by balanced measures to avoid becoming blanket prohibitions that harm all parties involved.
