NTB High Court Upholds Six-Year Sentence for Radiet Adiansyah
The high court upheld Mataram District Court Decision Number 12/Pid.B/2026/PN Mtr, which had been appealed by the parties.
Mataram (ANTARA) - The High Court of West Nusa Tenggara (NTB) has upheld the Mataram District Court ruling sentencing Radiet Adiansyah to six years in prison in the case of the death of student Made Vaniradya Puspa Nitra at Nipah Beach.
Spokesperson for the Mataram District Court, Kelik Trimargo, said in Mataram on Thursday that the appellate ruling upheld Mataram District Court Decision Number 12/Pid.B/2026/PN Mtr, which had been appealed by the parties.
“So, the high court upheld the Mataram District Court Decision Number 12/Pid.B/2026/PN Mtr that the parties had appealed,” he said.
Kelik said the NTB High Prosecutor’s Office, as the party that filed the appeal, still has 14 days after the ruling was read out on Tuesday (28/7) to determine its next legal step.
“Whether we proceed with a cassation appeal or not, we are still awaiting instructions from our leadership. So we are still considering things within the filing period,” he said.
“We will file for cassation,” he said.
According to Kusnaini, the cassation petition is expected to bring the dissenting opinion of Presiding Judge Mukhlassuddin into consideration during examination at the cassation level.
In the Mataram District Court ruling of 10 June 2026, Mukhlassuddin expressed a differing opinion from the two member judges. He assessed that a third party had played a role in committing the criminal act that caused the victim’s death.
Based on the majority vote, the panel of judges found Radiet proven to have violated the second alternative charge, namely Article 466 paragraph (3) of Law Number 1 of 2023 on the Criminal Code concerning assault resulting in the victim’s death.
The ruling differed from the prosecutor’s demand, which had sought a 13-year prison sentence under the primary charge, namely Article 458 paragraph (1) of Law Number 1 of 2023 on the Criminal Code concerning murder.
