No Need for Physical Visits: KKPR Can Be Applied for Online
Business actors who wish to develop their businesses need to obtain a Spatial Utilisation Activity Compliance Permit (KKPR). The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is responsible for ensuring that the utilisation of space by business actors complies with the applicable Spatial Planning Plan (RTR) in a particular region. The provisions regarding KKPR are regulated in Government Regulation No. 21 of 2021 on the Implementation of Spatial Planning. Through this regulation, the government regulates the utilisation of space so that development proceeds in an orderly, planned manner and does not cause land use conflicts. In practice, KKPR applications are submitted online through the national integrated Online Single Submission (OSS) system. Through this system, business actors do not need to come directly to the office to submit applications. Business actors simply need to fill in a number of data related to their business activity plans in the system. This data serves as the basis for the Ministry of ATR/BPN to assess the compliance of the planned activities with the applicable RTR. After the application is submitted via OSS, the next stage is examination and assessment by the authorised agency. The assessment is conducted by referring to the Regional Spatial Planning Plan (RTRW) document or the Detailed Spatial Planning Plan (RDTR). This aims to ensure that the business location is not in an area that is restricted or has special provisions for space utilisation. However, if not yet integrated, the application will go through a further assessment process until the KKPR approval is issued. In its implementation, the Provincial BPN Regional Office and the local Land Office also conduct verification, technical assessments, and provide considerations for applications that require further study. If all stages have been completed and declared compliant with the RTR, the KKPR document will be issued electronically. Thus, business actors can plan their business activities with greater certainty while supporting orderly space utilisation.
