The Head of the National Nutrition Agency (BGN), Sudaryono, has emphasised that his agency will comply with the Constitutional Court (MK) ruling concerning the separation of the budget for the Free Nutritious Meal (MBG) programme from the education budget.

“Of course, we will implement whatever decision is made by the state and the government’s policies,” Sudaryono told reporters at the BGN Office in Central Jakarta on Friday, 31 July 2026. However, he noted that the specific budgetary scheme will be discussed by the Ministry of Finance and relevant financial institutions. “Our core focus is on implementation; we are the executing body,” he added.

Previously, the Constitutional Court partially granted a petition regarding the MBG programme budget. The lawsuit was filed by the Taman Belajar Foundation and five individual petitioners against Article 22, paragraph 3 of the 2026 State Budget Law (UU APBN).

The Court ruled that while the MBG budget allocation in the 2026 State Budget remains conditionally constitutional, the MBG budget must be separated from the education budget allocation. The Court stipulated that this separation must be implemented in the 2027 State Budget and realised no later than 2028.

The decision was read during a session held at the Constitutional Court Building in Central Jakarta on Thursday, 30 July 2026.

“It is important for the Court to emphasise that the minimum 20% allocation for education is intended to fund the primary components of education,” stated Constitutional Court Judge Enny Nurbaningsih. These primary components include students, educators, educational staff, infrastructure, curriculum, as well as educational evaluation and development.

“Funding for these primary components does not include funding for the MBG programme,” Enny concluded.
