Nadiem's Legal Team to Report Jakarta Corruption Court Judges to Supreme Court Supervisory Body
Jakarta (ANTARA) - The legal team of defendant Nadiem Anwar Makarim is set to report four judges of the Corruption Crime Court at the Central Jakarta District Court to the Supreme Court’s Supervisory Body (Bawas MA).
The four judges — Purwanto S. Abdullah, Sunoto, Eryusman, and Mardianto — were previously reported to the Judicial Commission (KY) on Monday (7/6).
“These panel judges, in their considerations, failed to deliberate properly and correctly according to the facts of the trial and the evidence revealed in court,” said Nadiem’s lawyer, Zaid Mushafi, when met in Jakarta on Wednesday.
He said the report would be filed possibly this week or at the latest next week.
Zaid said reporting the judges to both the KY and Bawas MA is constitutionally justified, as both are institutions that oversee judges’ codes of ethics and conduct.
According to him, neither the KY nor Bawas MA will assess the substance of the trial or judicial technicalities. However, if evidence is indeed found, he believes it could be justified.
In addition, he revealed that several of the panel’s considerations were deemed inappropriate under the code of ethics to serve as the basis of the verdict.
“That is why we are reporting one of the member judges. Why? Because of impartiality in the witness examination process, but the focus is on the code of ethics,” he said.
In the alleged corruption case concerning the education digitalisation programme — the procurement of Chromebook laptops and Chrome Device Management (CDM) at the Ministry of Education, Culture, Research, and Technology between 2019 and 2022 — Nadiem was sentenced to 10 years in prison after being proven guilty of corruption.
In addition to the prison sentence, he was fined Rp1 billion, subsidised by 190 days’ imprisonment, and ordered to pay restitution of Rp809.59 billion, subsidised by five years’ imprisonment.
The restitution was imposed on Nadiem after he was proven to have received Rp809.59 billion originating from PT Aplikasi Karya Anak Bangsa (PT AKAB) through PT Gojek Indonesia. The majority of PT AKAB’s funds came from a Google investment worth US$786.99 million.
In that case, Nadiem was proven to have abused his authority, causing Rp1.56 trillion in losses to state finances.
The corruption was carried out, among other things, by procuring information and communication technology-based learning tools in the form of Chromebook laptops and CDM in the 2020, 2021, and 2022 fiscal years, contrary to procurement planning and procurement principles.
The founder of a technology company was declared to have committed these acts together with three other defendants who had been convicted in separate trials, namely Ibrahim Arief alias Ibam, Mulyatsyah and Sri Wahyuningsih, as well as Jurist Tan, who remains at large.
Nadiem was therefore proven to have violated criminal provisions under Article 3 in conjunction with Article 18 of Law Number 31 of 1999 on the Eradication of Corruption Crimes, as amended and supplemented by Law Number 20 of 2001, in conjunction with Article 55 paragraph (1) sub-paragraph 1 of the Criminal Code.
