Nadiem Makarim Sentenced to 10 Years in Prison for Chromebook Procurement Corruption, State Losses Reach Rp 1.5 Trillion

The panel of judges at the Jakarta Corruption Court has declared that the state financial loss resulting from the actions of former Minister of Education, Culture, Research, and Technology, Nadiem Anwar Makarim, in the Chromebook and Chrome Device Management (CDM) procurement amounts to Rp 1.5 trillion. The judge stated that the calculation of the loss, covering the procurement period from 2020 to 2022, was definitive and certain.

“The state financial loss for the 2020-2022 period is therefore Rp 1,567,888,662,716.74 (1.5 trillion),” said panel judge Mardiantos during the verdict reading at the Jakarta Corruption Court on Tuesday (30/6).

The judge affirmed that the calculation of the state financial loss by the Financial and Development Supervisory Agency (BPKP) was real and certain, and that the calculation was methodologically sound. “The method of calculation used by the BPKP is documentarily traceable,” the judge noted. The court explained that the BPKP calculated the difference between the net payment realisation and the fair value that should have been paid by the state. This was done by multiplying the number of units procured, which were fully recorded in the procurement documents, by the price difference between the charged price and the fair market price for similar goods at the time of procurement.

Earlier in the session, the presiding judge delivered the sentence. “Declares the defendant Nadiem Anwar Makarim legally and convincingly guilty of committing a criminal act of corruption jointly, as per the subsidiary indictment,” said chief judge Purwanto S Abdullah. “Sentences the defendant Nadiem Anwar Makarim to 10 years in prison.”

The judge stated that the primary indictment was not proven. Makarim was found guilty under the subsidiary indictment, violating Article 604 in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 20 letter c of Law No. 1 of 2023 concerning the Criminal Code. In addition to the prison sentence, the court also imposed a fine of Rp 1 billion, with a subsidiary of 190 days’ confinement, and ordered Makarim to pay restitution of Rp 809 billion.
