Jakarta - The legal counsel for three defendants in the case of the murder of Mohammad Ilham Pradipta, the branch head of a state-owned bank, considers the indictment drafted by the Military Prosecutor II-07 unacceptable.

“I state that the Indictment Letter of Military Prosecutor II-07 Jakarta No. Resdak/49/K/III Roman/2026 dated 6 April 2026, which has been presented by the Military Prosecutor in the trial on 6 April 2026, is null and void by law or, according to the law, the indictment of Military Prosecutor II-07 Jakarta is unacceptable,” said the defendant’s counsel, Lieutenant Colonel Chk Nugroho Muhammad, during the trial on Monday (13/4/2026).

Nugroho assessed that the indictment read by the Military Prosecutor does not contain a careful, clear, and complete description of the facts related to the charged criminal act.

Additionally, Nugroho stated that the determination of the suspect for Defendant III is not based on at least two valid pieces of evidence.

“There is no alleged criminal act committed, no connection of the Defendant to the case, thus the process does not comply with legal procedures,” explained Nugroho.

Previously, the Military Prosecutor’s Office (Otmil) II-07 Jakarta indicted Serka Mochamad Nasir, Kopda Feri Herianto, and Serka Franky Yari in the premeditated murder case related to the death of the state-owned bank branch head, Mohammad Ilham Pradipta, at the Military Court II-08 Jakarta.

Military Prosecutor Major Chk Wasinton Marpaung stated that the actions of the defendants fulfil the elements of the criminal offence as regulated in Article 340 of the Criminal Code in conjunction with Article 55 paragraph (1) first of the Criminal Code, in conjunction with Article 459 of Law No. 1 of 2023 on the Criminal Code, as well as in conjunction with Article 20 letter a of the same law.

“Article 338 of the Criminal Code jo Article 55 paragraph 1 first of the Criminal Code jo Article 458 paragraph 1 of Law No. 1 of 2023 on the Criminal Code jo Article 20 letter d,” stated the Military Prosecutor.

Not only that, the prosecutor also submitted an alternative indictment in the form of deprivation of liberty that resulted in the victim’s death.

Specifically for defendant Nasir, the military prosecutor added an indictment related to the act of concealing the death.

“Article 181 of the Criminal Code jo Article 55 paragraph 1 first of the Criminal Code jo Article 270 of the Republic of Indonesia Law No. 1 of 2023 on the Criminal Code jo Article 20 letter a of Law No. 1 of 2023 on the Criminal Code,” he revealed.
