MPR Signs MoU to Be Involved in Constitutional Interpretation in MK Rulings

The People’s Consultative Assembly (MPR) leadership visited the Constitutional Court (MK) to discuss their respective authorities regarding the interpretation and amendment of the 1945 Constitution. During the visit, where they were received by all MK judges, the MPR confirmed the signing of a memorandum of understanding (MoU). The MoU stipulates that the MPR will be involved in the constitutional interpretation and decision-making processes at the MK. “We have signed [the MoU], I as Chairman of the MPR, and Mr Suhartoyo as Chairman of the MK, an MoU between the MPR and MK regarding copies of MK decisions where the MPR will receive copies and in many cases the MPR will be asked for its views in the MK’s drafting of rulings,” said MPR Chairman Ahmad Muzani at a press conference on Wednesday (8/7). The Gerindra Party politician explained that according to the constitution, the MPR is tasked with amending the Constitution, while the MK is authorised to interpret it, including reviewing the constitutionality of laws produced by the DPR and the government. Muzani stated that the MPR and MK have so far worked within their respective corridors, ensuring neither institution interferes with the other’s authority. However, he argued that because the MPR is constitutionally the institution considered to understand the constitution best, it must be involved in every MK decision-making process. “Therefore, before the Constitutional Court makes a decision on that interpretation, we remind them, we convey, that they should also listen to the MPR’s views when the constitution was drafted or amended,” he said. In addition to discussing institutional authority, the MPR also delivered an invitation to the annual session scheduled for 16 August. According to Muzani, the MPR will embark on a tour of state institutions to deliver the invitation. Besides the MK, they will also visit the Supreme Court and party chairpersons. “After this, we will meet with the Supreme Court, perhaps next week, and we will meet with all state institutions, including the President,” he stated.
