Moge Owner Released After Fatal Crash Involving 10-Year-Old in Toraja Utara
Investigators from Toraja Utara Regional Police Traffic Unit have suspended the detention of a motorbike (moge) owner, identified as RR (42), following a collision that killed a 10-year-old child. The case has been resolved through restorative justice (RJ).
Toraja Utara Regional Police Traffic Chief, Iptu Muhammad Nasrum Sujana, explained that the legal action was taken following requests from all parties involved in the incident, particularly the suspect’s family and the victim’s family.
“The suspension of detention was based on several important considerations to uphold justice, benefit, and certainty for both parties,” Nasrum stated on Tuesday (26 May).
“Among the key factors is the request from all parties to resolve the case through restorative justice mechanisms,” he said.
Nasrum also noted the suspect’s cooperative attitude and compliance with all legal procedures during the investigation and inquiry phases.
“The primary point is the family-level peace agreement reached between the suspect and the victim’s family. The victim’s family voluntarily requested the accident case be resolved via restorative justice,” he explained.
From a social, cultural, and moral accountability perspective, both parties agreed on peace terms, including the suspect’s sincere apologies, deep remorse, and condolences, which were warmly and sincerely accepted by the victim’s family.
“The suspect willingly and sincerely participated in the customary burial process. Most importantly, the victim’s family has accepted the suspect as a new family member,” he added.
Based on the considerations and agreement, both parties requested the competent law enforcement authorities to resolve the case through restorative justice and agreed not to pursue criminal charges against the suspect.
“With the suspension of detention granted, the future resolution of the case is expected to proceed smoothly, ensuring legal certainty that upholds humanity, justice, and mutual benefit for both parties,” he concluded.
