MKMK Chairman Would Rather Be Dismissed Than Leak Adies Kadir Report
Jakarta, VIVA – The Chairman of the Constitutional Court's Ethics Council (MKMK), I Gede Dewa Palguna, refused to disclose the contents of a complaint against Constitutional Court Justice Adies Kadir when pressed by legislators during a Commission III hearing at the House of Representatives (DPR). Palguna stated he would rather be dismissed as MKMK Chairman than reveal the report.
Palguna made the remarks during a meeting with Commission III at the parliamentary complex in Senayan, Jakarta, on Wednesday, 18 February 2026.
Members of Commission III had initially asked Palguna to elaborate on the examination process regarding the complaint against Justice Adies Kadir, who was nominated by the DPR.
However, Palguna firmly stated he would not disclose the report, as doing so would constitute a breach of his oath.
"As far as the substance of the matter we are handling is concerned, ladies and gentlemen, we cannot disclose it here. It is simply not possible. We would be violating our oath and breaching procedural law," Palguna said.
Palguna was responding to a Commission III member who had described his presentation on the Adies Kadir report as overly legalistic. He insisted he could not reveal the substance of the complaint against Kadir.
"So when someone here asked us — you said our report was far too legalistic — what about the Adies Kadir process? We simply cannot disclose that, sir. That is our independence. If that is what you are demanding, I would rather request my own dismissal from the Ethics Council. I am serious. Because that is the crown jewel of the Ethics Council's integrity, sir," he said.
It is understood that 21 professors, lecturers and legal practitioners belonging to the Constitutional and Administrative Law Society (CALS) filed a complaint against Constitutional Court Justice Adies Kadir with the MKMK.
Kadir was reported because his nomination as a constitutional justice by the DPR is alleged to have violated the code of ethics, judicial conduct guidelines for Constitutional Court justices, and prevailing legislation. The complaint was described as an effort to safeguard the dignity and honour of the Court.
"It is not only about adjudicating or resolving cases once someone has become a justice — we want the MKMK to be more deeply involved in examining the process by which a person becomes a justice," said CALS representative Yance Arizona, as reported by Antara on Friday, 6 February 2026.
