MK delivers 13 rulings on material review of laws today
The Constitutional Court held a hearing today, Monday, to announce rulings on material review applications of laws. The cases include Case No. 163/PUU-XXIV/2026, challenging provisions of the 2008 Electronic Information and Transactions (ITE) Law filed by Malik Fahad. The applicant sought a review of Article 27A, arguing it is conditionally unconstitutional unless interpreted to state that acts done in the public interest, self-defense, or criticism of public policy do not constitute defamation. Case No. 161/PUU-XXIV/2026, filed by Lintang Dwi Ramadhani, challenged Article 27(3) of the ITE Law. Both cases were only heard up to the preliminary examination stage, similar to previous challenges by Roy Suryo and others. Case No. 144/PUU-XXIV/2026, filed by Deny Syahputra and Heru Isdaryadi, concerned constitutional complaints and was heard only twice: preliminary examination and application revision. Case No. 85/PUU-XXIV/2026, filed by Henoch Thomas and others, challenged the 2004 Bankruptcy and Debt Restructuring Law. Case No. 14/PUU-XXIV/2026, filed by Albert Riyadi Suwono, reviewed the same bankruptcy law and also the 1983 Tax Law, as amended by the 2021 Tax Harmonisation Act. The court heard testimony from government, DPR, and expert witnesses. Case No. 181/PUU-XXIV/2026, filed by Sandi Ebenezer Situngkir, also challenged the 2004 Bankruptcy Law. Case No. 133/PUU-XXIV/2026, filed by Fairuz Najwa Sahara Tanjung, reviewed the 2022 Personal Data Protection Law, heard only up to application revision. Case No. 128/PUU-XXIV/2026, filed by Fatati Nailul Munadia, challenged amendments to the 2017 Elections Law. Case No. 134/PUU-XXIV/2026, filed by Tommy Hasanuddin Gurning, reviewed the 2009 Aviation Law, heard only up to application revision. Case No. 137/PUU-XXIV/2026, filed by Ingrid Tanama and others, challenged the 2025 Criminal Procedure Code (KUHAP) Law. Case No. 135/PUU-XXIV/2026, filed by Sri Wahyuni, reviewed the 2023 Criminal Code (KUHP), with applicants arguing that Article 609(1) uses overly broad language. Thirty-six similar KUHP challenges have been reviewed by the MK to date. Case No. 154/PUU-XXIV/2026, filed by Tri Wahyu Budi Santoso, challenged the 2025 KUHAP Law, heard only up to preliminary examination. Case No. 136/PUU-XXIV/2026, filed by Sandi Silvia, reviewed the 2003 Advocate Law. The ruling hearing began at 2 PM WIB. Prior to this, the MK held hearings for relevant parties from 10:30 AM regarding material reviews of the 2005 Teacher and Lecturer Law, filed by Ketut Aswana and Isman Rahmani Yusron under Cases No. 24/PUU-XXIV/2026 and 272/PUU-XXIV/2026. A 1 PM hearing followed for Case No. 158/PUU-XXIV/2026, a material review of the 2025 KUHAP Law filed by Febri Wahyuni, focusing on application revisions. Further application revisions were heard for Case No. 159/PUU-XXIV/2026 concerning the 1947 Marriage Law, filed by Adv. Moratua Silaban, and Case No. 160/PUU-XXIV/2026 regarding the 2004 State Finance Law, filed by Hambali Julianto.
