Mitigating Factors Cited in Sentencing of Three TNI Soldiers for Murder of State-Owned Bank Branch Manager
The Military Prosecutor II-01 Jakarta has revealed several mitigating factors regarding the sentencing of three defendants involved in the murder of Mohammad Ilham Pradipta, a branch manager of a state-owned bank (BUMN). The defendants have been identified as Serka Mochamad Nasir, Kopda Feri Herianto, and Serka Frengky Yaru.
According to Military Prosecutor Major Chk Wasinton Marpaung, one of the mitigating factors is that the defendants have previously participated in military operations. Additionally, the defendants have expressed deep remorse for their actions in the killing of Mohammad Ilham Pradipta.
“The third defendant received a request for leniency from the Head of Logistics for Kopassus via letter Number B/81/V/2026, dated 12 May 2026, regarding a request for reduced punishment for Serka Frengky Yaru,” stated Marpaung.
During the reading of the indictment on Monday (18/5/2026), Marpaung announced that the first defendant, Serka Mochamad Nasir, faces a primary sentence of 12 years in prison, minus time already served in detention. Nasir also faces the additional penalty of dishonourable discharge from the TNI military service.
He was charged with murder committed jointly as regulated under Article 338 of the Criminal Code in conjunction with Article 55 Paragraph (1) 1st of the Criminal Code, and Article 458 Paragraph (1) of the Indonesian Law Number 1 of 2023. Furthermore, he is charged with concealing a corpse to hide the death, as regulated under Article 181 of the Criminal Code in conjunction with Article 270 of Law Number 1 of 2023.
The second defendant, Kopda Feri Herianto, faces a primary sentence of 10 years in prison, minus time served, along with the additional penalty of dismissal from the Indonesian Army. The prosecution further noted that the second and third defendants are charged with the deprivation of liberty resulting in death, as stipulated under Article 333 Paragraph (3) of the Criminal Code and related provisions of Law Number 1 of 2023.
