Ministry of Human Rights to Appeal PTUN Ruling on Transferred Employee
The Ministry of Human Rights (KemenHAM) is lodging an appeal against a State Administrative Court (PTUN) ruling that granted a lawsuit filed by KemenHAM employee Ernie Nurheyanti M Toelle regarding a staff transfer. Deputy Minister of Human Rights Mugianto confirmed the appeal when asked by journalists about Minister Pigai’s stance on the PTUN decision in Jakarta on Tuesday. “We will appeal, we will definitely appeal. His (Minister Pigai’s) response is that we will appeal,” said Mugianto. Mugianto stated that the ministry regretted the step taken by Yanti, as Ernie is known, and that the dispute should not have escalated to the PTUN. According to him, the action was not a dismissal but a transfer or change of position. “Actually, this issue did not need to happen. And we regret the step taken by Mrs Yanti. Because this is not a dismissal, it is merely a transfer of position, a mutation,” he said. He assessed that the legal action taken by Yanti was inappropriate because it had a negative impact on the Ministry of Human Rights, which was established by President Prabowo Subianto. “In our view, what Mrs Yanti did was not appropriate, because the impact is not good for the ministry. Even though this is a ministry formed by the President. So we will appeal,” said Mugianto. The State Administrative Court (PTUN) on Thursday (2/7) granted the lawsuit of KemenHAM employee Ernie Nurheyanti M Toelle, registered in the Jakarta PTUN Case Tracing System under case number 59/G/2026/PTUN.JKT. Ernie was formerly the Secretary of the Directorate General of Human Rights Services and Compliance before being transferred to the position of Senior Expert Human Rights Analyst. She subsequently challenged the Transfer Decree that moved her to a functional role from a managerial one. In her lawsuit, she requested that Minister Pigai restore her dignity, honour, and position to its original state, equivalent to an Echelon 2A role as Secretary of the Directorate General. In the PTUN ruling, the panel of judges annulled the Decree of the Minister of Human Rights of the Republic of Indonesia Number: MHA-14, KP.04.04 Year 2026, dated 23 January 2026, concerning the appointment through transfer from a managerial position to a functional position within the Ministry of Human Rights on behalf of Ernie Nurheyanti M Toelle.
