Military Prosecutor in Andrie Yunus Case: Four TNI Soldiers Were Honest and Frank
The Military Prosecutor II-07 Jakarta has revealed several mitigating circumstances for four members of the TNI Strategic Intelligence Agency (BAIS) Detachment, resulting in a sentencing demand of only 2.5 years in prison in the acid attack case against KontraS activist Andrie Yunus. The prosecutor stated that the defendants were honest and frank in providing testimony during the trial.
“Mitigating factors: second, the defendants were honest and frank during the trial,” the prosecutor stated while reading the indictment at the Military Court II-08 Jakarta on Wednesday (3/6). Other mitigating factors include the defendants’ lack of prior criminal records, their expressed remorse, and their promise not to repeat the offence. Conversely, the aggravating factors include the defendants’ actions contradicting the Sapta Marga, the soldier’s oath, and the eight duties of the TNI, as well as the damage to the TNI’s reputation and the severe injuries inflicted upon Andrie.
The prosecutor has requested the panel of judges at Military Court II-08 Jakarta to sentence the defendants to 2 years and 6 months in prison. The four BAIS TNI soldiers facing trial are Sergeant Edi Sudarko, Lieutenant Budhi Hariyanto Widhi, Captain Nandala Dwi Prasetyo, and Lieutenant Sami Lakka.
Based on the legal facts revealed in court, the prosecutor stated that the defendants splashed the acid due to resentment or anger stemming from negative sentiments towards Andrie. They perceived him as having insulted the dignity of the TNI during an interruption of a closed-door meeting with the TNI at the Fairmont Hotel regarding the TNI Bill revision in March 2025. This act is regulated under Article 467, paragraph 1 in conjunction with paragraph 2 and Article 20 letter C of Law Number 1 of 2023 (the Criminal Code), which covers premeditated assault with maximum prison terms of 4 to 7 years.
In this legal process, Andrie, as the victim, has not been examined because he remains under intensive care at RSCM Jakarta. While the investigators and military prosecutor appeared to be accelerating the case proceedings, the judges expressed a desire to hear testimony from Andrie. However, as he was not included in the case files, his capacity is limited to that of an additional witness. This move was strongly opposed by Andrie and his legal counsel from the Advocacy Team for Democracy (TAUD), who cited concerns regarding impunity and a lack of trust in military courts presiding over general criminal offences. According to RSCM, Andrie remains under the care of a multidisciplinary medical team, including specialists in reconstructive plastic surgery, ophthalmology, and psychiatry, as he undergoes post-operative recovery.
