Military Prosecutor Hands Over 11 Pieces of Evidence in KontraS Activist Case

Jakarta (ANTARA) - The Military Prosecutor’s Office II-07 Jakarta has handed over 11 items of evidence related to the alleged assault on activist Andrie Yunus from the Commission for Missing Persons and Victims of Violence (KontraS), concurrent with the transfer of the case file to the Military Court II-08 Jakarta.

“Besides handing over the case file, we have also submitted 11 items of evidence to the Military Court II-08 Jakarta,” said the Head of the Military Prosecutor’s Office II-07 Jakarta, Colonel Chk Andri Wijaya, at the Military Court II-08 Jakarta on Thursday.

The 11 items of evidence were collected during the investigation process and consist of various objects allegedly directly related to the incident of the suspected assault.

The evidence submitted includes one tumbler glass, one pair of glasses, one white T-shirt, one pair of shoes, one pair of trousers, one shirt, one black helmet with its padding, one flash drive containing video, one used battery bottle, one bottle of residual rust cleaner liquid, and two motorcycles.

Based on observations at the location, the evidence was packed in one large cardboard box to facilitate the handover and administrative examination process.

Meanwhile, the two large-sized motorcycles as evidence were presented separately in the court area.

The handover of the evidence is a crucial part of the case transfer stage, as all of it will be examined during the trial process.

The panel of judges will later assess the relevance and strength of each piece of evidence in uncovering the legal facts.

The entire case handling process is conducted openly and accountably. According to him, the completeness of the evidence submitted is an important part of ensuring that the legal process runs according to procedure.

“We want transparency and accountability to be implemented so that it does not go astray,” Andri stated.

With the transfer of the case file and evidence, the case now enters the trial stage.

The process is expected to proceed objectively, transparently, and provide legal certainty for all parties.

Previously, the Military Court II-08 Jakarta officially received the case file for the alleged assault on KontraS activist Andrie Yunus from the Military Prosecutor’s Office II-07 Jakarta.

“It is true that today the Military Court II-08 Jakarta has received the transfer of the case file from the Military Prosecutor’s Office II-07 Jakarta. The case in question is the alleged acid splashing against the KontraS activist, which will soon be tried,” said the Head of the Military Court II-08 Jakarta, Colonel Chk Fredy Ferdian Isnartanto, at the Military Court II-08 Jakarta on Thursday.

He assured that the court will immediately follow up on the transfer with judicial administrative processes before entering the first hearing.

In addition, the clerk will prepare the schedule for the first hearing and ensure that the summoning of related parties is carried out in accordance with legal provisions.

Fredy mentioned that the summoning of the defendants and witnesses must be done legally and properly, namely at least three days before the hearing is held.

This is important to guarantee the smooth running of the trial process and the fulfilment of the rights of all related parties in the case.

In the case, there are four military members who have been designated as defendants. They consist of three officers and one non-commissioned officer, namely Captain NDP, First Lieutenant BHW, First Lieutenant SL, and Second Sergeant ES.

All four were previously suspects and are now officially defendants after the case file was transferred to the court.

The case is registered under number 55/K/207/AL-AU/IV/2026 dated 13 April 2026. The file includes the evidence, four defendants, and eight witnesses who will be presented at the trial.

Of the eight witnesses, five are military members, while the other three are from civilian circles.

Furthermore, the subsidiary charge is under Article 448 paragraph (1) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum penalty of eight years’ imprisonment.

Meanwhile, the principal subsidiary charge uses Article 467 paragraphs (1) and (2) juncto Article 20 letter C of Law Number 1 of 2023 with a maximum sentence of seven years’ imprisonment.

As is known, the TNI Military Police Centre (Puspom) detained four TNI personnel suspected of involvement in the acid splashing case against the Deputy Coordinator of the Commission for Missing Persons and Victims of Violence (KontraS) Andrie Yunus.

“So, now the four suspects are secured at the TNI Puspom for further investigation to the prosecution level,” said the Commander of the TNI Puspom, Major General TNI Yusri Nuryanto, in Jakarta on 18 March 2026.

The four suspects are now threatened with Article 467 of the Criminal Code paragraphs 1 and 2, with a maximum penalty of 7 years’ imprisonment.

Yusri assured that the TNI Puspom works professionally and transparently, and ensures that all findings by TNI investigators are conveyed openly in the trial.
