Military Prosecutor Applies Assault Charges in Andrie Yunus Case
The Head of the Military Prosecutor’s Office II-07 Jakarta, Colonel Chk Andri Wijaya, stated that four TNI suspects in the acid splashing case against activist and Deputy Coordinator of KontraS Andrie Yunus will be charged with layered articles.
“The prosecutor is applying layered articles,” Andri said when contacted on Monday (13/4).
He explained that the articles to be applied are Article 469 paragraph (1) of the Criminal Code in conjunction with Article 20 letter c of the Criminal Code, Article 468 paragraph (1) of the Criminal Code in conjunction with Article 20 letter c of the Criminal Code, and Article 467 paragraph (1) in conjunction with paragraph (2) of the Criminal Code in conjunction with Article 20 letter c of the Criminal Code.
Article 469 paragraph (1) states that any person who commits serious assault with prior planning shall be punished with imprisonment for a maximum of 12 years.
Article 468 paragraph (1) states that any person who seriously injures another person shall be punished for serious assault with imprisonment for a maximum of 8 years.
Article 467 paragraph (1) states that any person who commits assault with prior planning shall be punished with imprisonment for a maximum of 4 years.
He explained that the case file has currently been examined for formal and material requirements and declared complete.
“Currently, we are processing the case file to immediately send the minutes of opinion (Bapat) and legal opinion suggestion (SPH) from the Prosecutor to the Papera (Case Submitting Officer) to obtain the Skeppera, after which the Prosecutor will prepare the indictment to be handed over to the Military Court for trial,” he said.
Andrie became a victim of the acid splashing on Thursday (12/3) night.
KontraS Coordinator Dimas Bagus Arya stated that the incident occurred after Andrie Yunus attended a podcast event titled “Remilitarism and Judicial Review in Indonesia” at the office of the Indonesian Legal Aid Foundation (YLBHI), around 23:00 WIB.
“He was attacked with acid splashing by Unknown Persons (OTK), resulting in serious injuries all over his body, especially on the right and left hand areas, face, chest, and eye area,” he said in a written statement on Friday (13/3).
Less than a week later, or on Wednesday (18/3), the TNI Central Inspectorate (Puspom TNI) secured four members suspected of being involved in the incident.
The four are NDP with the rank of captain, SL and BHW with the rank of first lieutenant, and ES with the rank of second sergeant.
They are assigned to the Detachment Headquarters of the TNI Strategic Intelligence Agency (Denma BAIS), originating from the Navy and Air Force.
The Puspom TNI investigators then completed the entire series of investigation processes for the case.
Then on Tuesday (7/4), the case file, the suspects, and evidence of the criminal act were handed over from the Puspom TNI investigators to the Military Prosecutor’s Office II-07 Jakarta, to subsequently examine the completeness of the formal and material file requirements.
“If the file is declared complete, it will be handed over to the Military Court II-08 Jakarta. The suspects handed over number four people with initials: NDP, SL, BHW, ES along with evidence,” said the Head of TNI Information Centre (Kapuspen) TNI Major General Aulia Dwi Nasrullah in a written statement.
Civil coalitions continue to urge the TNI to hand over this case to the Attorney General’s Office so that the suspects are tried in a general court. They also urge the perpetrators to be charged with attempted murder articles.
