Metro Jaya Police Claim Three Pieces of Evidence Justify Naming Roy Suryo a Suspect
The Metro Jaya Regional Police stated that the naming of telematics expert KMRT Roy Suryo Notodiprojo as a suspect met the evidentiary requirements stipulated in Article 184 of Law Number 8 of 1981 concerning Criminal Procedure (KUHAP) and Constitutional Court Decision Number: 21/PUU-XII/2014. This was conveyed by the Metro Jaya Police legal team in their response to Roy’s pre-trial motion at the South Jakarta District Court on Monday (13/7), regarding his suspect status in an alleged defamation case linked to the diploma of Indonesia’s 7th President, Joko Widodo.
“In this case, at the time of the applicant’s designation as a suspect, the respondent had fulfilled and even exceeded the minimum standard because the suspect determination was based on at least three types of valid evidence according to Article 184 of the KUHAP,” a member of the Metro Jaya Police legal team stated in the Oemar Sejo Adji courtroom. The three pieces of evidence held by investigators include corroborating witness statements, documentary evidence or clues, and the opinions of 26 experts.
The Metro Jaya Police legal team emphasised that this evidence was not only assessed internally but had also been formally tested by the Public Prosecutor, who declared the case file complete, or P21. “Furthermore, after the handover of the suspect and evidence, known as stage II, on 19 June 2026, this demonstrates that the evidence collected by the respondent is deemed sufficient by the Public Prosecutor to proceed with the case to the prosecution stage,” the team stated. They added that Roy had also been examined in his capacity as a prospective suspect or witness before being named a suspect.
“Therefore, the applicant’s argument stating there was no sufficient preliminary evidence or valid evidence in the suspect determination is not in line with the provisions of the relevant Constitutional Court Decision and Article 184 of the KUHAP, nor does it correspond with the facts of the investigation process in this case. On that basis, the argument is legally unfounded and should be rejected in its entirety,” the team declared. The police legal team also explained the reason investigators were still using the old KUHAP, noting that the case entered the investigation phase before Law Number 20 of 2025 concerning the new KUHAP came into effect on 2 January 2026.
In their concluding request, the Metro Jaya Police legal team asked the sole judge examining the case to reject the pre-trial motion in its entirety. Previously, Roy, through his lawyer Refly Harun, requested the court declare the police investigation into the alleged fake diploma of the 7th President Joko Widodo unlawful and invalid. This is the second pre-trial motion filed by Roy; the first, which challenged the police’s forced efforts including search, arrest, and detention, was won by Roy, with the judge ruling those actions were unlawful.
