Menekraf states creative services guidelines to prevent legal issues

The Minister of Creative Economy (Menekraf) Teuku Riefky Harsya stated that the government is preparing guidelines for creative economy services to provide certainty for industry players and prevent legal issues in the future.
“Tonight, we received Bung Amsal Sitepu, who faced legal challenges and problems. His visit is to discuss and provide input so that such incidents do not happen again to creative economy actors in Indonesia,” said the Minister after the event of the Creative Economy Minister’s Meeting with Amsal Sitepu at Autograph Tower Thamrin Nine, Jakarta, on Thursday.
He said the guidelines are still in the drafting process and will be socialised to various stakeholders, including law enforcement agencies, the Ministry of Home Affairs, and the Ministry of Finance.
“The output is how this guideline can explain that creativity is not worthless and its price cannot be fixed because it depends on the creativity outcome,” he said.
He added that the valuation of creative services cannot be standardised because it is influenced by various factors, such as the work area, the level of experience of the actors, and the type of work performed.
“If the price is fixed, there are several variables that cannot be equalised, such as the area, experience whether beginner or master, and the type of work like indoor or outdoor,” he said.
“Whether this guideline is sufficient as a ministerial decision or needs to be included in other regulations, we are still consulting on this,” he said.
He emphasised that the preparation of the guidelines is being done carefully to avoid creating new problems in its implementation.
“We do not want it to be rushed and end up harming and becoming a reference for further cases,” he said.
The government hopes that these guidelines can strengthen the creative industry ecosystem, which is currently continuously developing, including in the regions, while providing better protection for creative business actors.
