Mayoralty stops issuing permits to 22 developers
JAKARTA (JP): The West Jakarta mayoralty has meted out administrative punishment to 22 real estate developers for not fulfilling their obligations to build social and public facilities.
The chairman of the city council's Commission D for development affairs, Bandjar Marpaung, said yesterday that the mayoralty has suspended the issuance of any permits needed by the developers.
The permits include building development permits, zoning plan permits as well as land certificates, he added.
"This measure will continue to be imposed until the developers fulfill their obligations which are based on Gubernatorial Decree No. 540," Bandjar said.
He said the decree stipulates a holder of a land appropriation permit has the obligation to build and hand over public and social facilities to the city administration.
The facilities include roads, water ducts, mosques, schools and parks.
Another member of the commission, Mochammad Rodja, said the facilities which the companies should build and hand over are worth billions of rupiah.
For example, Rodja added, PT Metropolitan Development who controls 62.2 hectares of land in Duri Kosambi subdistrict, West Jakarta will hand over facilities worth Rp 39.66 billion (US$17.24 million).
"Therefore, I think the facilities that should be built by the 22 developers are worth billions of rupiah," he said.
The commission held a hearing with the mayoralty yesterday to learn of the latest development on developers obligations in West Jakarta.
According to Bandjar, the number is lower than last year, when the mayoralty penalized 30 developers who failed to fulfill their obligations.
From 1971 to 1995, the city administration issued 102 land appropriation permits to developers controlling 2,615 hectares of land in West Jakarta.
The mayoralty reported that in 1995 a total of 30 developers handed over facilities worth Rp 336.89 billion.
Officials of the city administration reported to the commission yesterday that in 1995 there were 238 developers throughout Jakarta who handed over public and social facilities worth Rp 784.98 billion.
Bandjar said the municipality should continue to take punitive action against errant and recalcitrant developers.
However, he urged the administration to issue a stronger decree than the current one which stipulates that the administration should be involved in building the facilities to control their quality.
"I think the main problem is the quality of the facilities. The city administration should allocate a budget to maintain the facilities three years after they are handed over," he said.
Bandjar said as the administration faces a problem in controlling the quality of the facilities, it has appointed a special agency in charge of checking and controlling the quality of the building materials used by the developers.
"By involving the agency, the quality of the facilities can be guaranteed," he said.
Bandjar said the agency has reported that it has rejected many of the facilities built by the developers because they do not meet the standard set by the agency. (yns)
