Marinus Gea pushes for legal certainty for the curator profession
Member of Commission XIII of the Indonesian House of Representatives (DPR RI), Marinus Gea, believes that legal certainty, protection, and a national code of ethics are essential to strengthen the professionalism, integrity, and accountability of the curator profession.
In a written statement received in Jakarta on Thursday, Marinus stated that legal protection is necessary because curators possess broad authority in managing and liquidating debtor assets during the bankruptcy process.
“There have been many instances of criminalisation, making it seem as though there is no legal protection for them, even though the curator profession acts as the executor of court decisions that must be followed up based on the rulings of the Commercial Court,” he said.
According to him, legal certainty is required so that curators can perform their professional duties without being vulnerable to legal issues, provided that their actions are carried out in accordance with their duties and authority.
“We must not allow curators to be easily criminalised while performing their professional duties simply because they are exercising the authority granted by law and court decisions. This is the certainty we must provide,” he added.
He noted that currently, each professional organisation for curators has its own respective ethical rules. Therefore, the Curator Profession Bill (RUU Profesi Kurator) needs to include a standardised code of ethics that can serve as a common reference for all curators.
Marinus emphasised that the Curator Profession Bill is not intended to eliminate existing provisions regarding curators as regulated in current legislation, particularly the Law on Bankruptcy and Suspension of Debt Payment Obligations (PKPU).
These views were expressed by Marinus during a working visit by the Working Committee (Panja) for the Drafting of the Curator Profession Bill of Commission XIII of the DPR RI in Medan, North Sumatra, on Wednesday (2/9).
During the visit, the Working Committee gathered input from various stakeholders regarding the regulation of the curator profession within the bill currently being drafted.
