LPSK to calculate restitution for human trafficking victims in Libya
Jakarta (ANTARA) - The Witness and Victim Protection Agency (LPSK) will calculate the amount of restitution to be received by victims of human trafficking (TPPO) in Libya, to ensure that all three victims receive their rightful entitlements.
“What can explain the value is LPSK, because the amount of restitution will be calculated from the extent of the losses suffered by the victims, along with various treatment measures and matters relating to the victims’ ongoing welfare,” said the Director of Women’s and Children’s Protection and Anti-Human-Trafficking (PPA-PPO) at Polda Metro Jaya, Police Commissioner Dr. Rita Wulandari Wibowo, at a press conference in Jakarta on Tuesday.
She continued that the amount to be received by the victims will certainly follow a standard formula, as adjustments are made for the victims’ placement location and circumstances. It is also calculated from costs relating to any medical treatment the victims may have required.
“This is what will be charged to the perpetrators, and it applies specifically to the crime of human trafficking,” she said.
For cases involving sexual exploitation, the calculation differs. In addition, there are other measures specifically regulated under the criminal procedure provisions of Law Number 12 of 2022 on Sexual Violence Crimes (TPKS).
“In their treatment, they may use a system of seizing restitution guarantees. So the mechanism, the provisions and the value all fundamentally derive from the analysis carried out by LPSK,” said Rita.
“LPSK will go down to coordinate with the accompanying team, and supporting evidence will be attached. They will be the ones to calculate the overall amount,” she said.
Earlier, Police Commissioner Dr. Rita Wulandari Wibowo, Director of PPA-PPO at Polda Metro Jaya, stated that the three victims of human trafficking, with the initials NAR (21), SS (45) and NKR (39), suffered economic exploitation because they had been placed in a country that is not a designated destination for Indonesian Migrant Workers (PMI).
“All three victims of human trafficking are women and adults. There is a decision from the Ministry of Manpower regarding designated PMI placement countries, and Libya is not among them,” she said.
Her unit, together with the General Crimes Directorate, has been carrying out handling and rescue efforts for the victims as well as law enforcement action.
The three victims are currently receiving intensive care, and upon their return home they will immediately undergo medical examinations.
