Lighter Sentence: Former Loteng Bapenda Treasurer Sentenced to 4 Years for PPJ Corruption
Former Treasurer of the Regional Revenue Agency (Bapenda) of Central Lombok (Loteng), West Nusa Tenggara (NTB), Lalu Bahtiar Sukmadinata, has been sentenced to four years in prison in a corruption case involving street lighting tax (PPJ) incentive payments for the period 2019-2023. This sentence is lighter than the prosecutors’ demand of 5.5 years imprisonment.
The panel of judges at the Mataram Corruption Court (Tipikor), chaired by Dewi Santini with members Ida Ayu Masyuni and Djoko Soepriyono, stated that the defendant was not proven guilty in a lawful and convincing manner on the primary charge brought by the public prosecutor.
“The defendant is therefore acquitted from that primary charge,” said Dewi while reading the verdict on Thursday (30/4/2026).
However, on the subsidiary charge, Lalu Bahtiar Sukmadinata was found guilty in a lawful and convincing manner of jointly committing a criminal act of corruption.
“It is therefore imposed a prison sentence of four years,” she stated.
In addition to the custodial sentence, the judges also imposed a fine of Rp 50 million, which must be paid no later than six months from the date the verdict gains legal force.
In the verdict’s operative part, the judges stipulated that the fine can be paid in instalments over 50 days at Rp 1 million per day.
“If the fine is not paid within the specified period, the defendant’s assets or income may be seized and auctioned by the prosecutor to settle the unpaid fine,” she explained.
“In the event that the assets or income are insufficient to pay the fine, it shall be replaced with imprisonment for 50 days,” she added.
The panel of judges stated that Lalu Bahtiar Sukmadinata violated Article 604 of Law No. 1 of 2023 on the Criminal Code in conjunction with Article 18 paragraph (1) letter b, paragraph (2), and paragraph (3) of Law No. 31 of 1999 on the Eradication of Criminal Acts of Corruption as amended by Law No. 20 of 2001 on Amendments to Law No. 31 of 1999 on the Eradication of Criminal Acts of Corruption in conjunction with Article 20 letters a, c, and d of Law No. 1 of 2023 on the Criminal Code.
“The pre-trial detention period served by the defendant is deducted from the imposed sentence. The defendant remains in detention,” she said.
Previously, the public prosecutor had demanded a prison sentence of five years and six months for Lalu Bahtiar Sukmadinata, along with a fine of Rp 300 million subsidiary 100 days.
Lalu Bahtiar Sukmadinata is a defendant in this case alongside the former Head of Bapenda Central Lombok for the 2019-2021 period, Lalu Karyawan, and the Head of Bapenda Central Lombok for 2021, Jalaludin.
