Level Crossings Are Temporary in Nature, Flyovers or Underpasses Must Be Built

JAKARTA, KOMPAS.com - A fatal accident has occurred again at a level crossing, involving an online taxi with a Commuter Line train and the KA Argo Bromo. According to Government Regulation (PP), level crossings are not mandatory. The regulations are stipulated in PP, Law (UU), and Minister of Transportation Regulation (Permenhub). Minister of Transportation Regulation No. PM 94 of 2018 regulates safety standards at level crossings. “What requires a level crossing is not the railway, but the public whose roads cross the railway line,” said transportation observer and Chairman of the Institute for Transportation Studies (Instran) Ki Darmaningtyas, when contacted by Kompas.com recently. Therefore, to reduce the risk of accidents, based on Government Regulation No. 56 of 2009 on Railway Services, Article 75 states that the intersection of railway tracks with roads shall be made non-level. It is further emphasised in Article 76 paragraph 1, namely that the non-level intersection as referred to in Article 75 may be above or below the railway track. Thus, a flyover or underpass can be built. The same article also explains the requirements for non-level intersections. Then, Article 77 explains level intersections or level crossings. In Article 77 paragraph 2, it is stated that to ensure the safety and smoothness of train travel and road traffic, level intersections must meet the following requirements: [requirements follow]. Furthermore, Article 77 paragraph 3 states that the level intersection as referred to in paragraph 1 is temporary and must be made into a non-level intersection if three factors are met. The first factor is that one of the requirements in paragraph 2 is not fulfilled.
