JAKARTA, KOMPAS.com - The government is reported to announce new rules regarding outsourcing or the subcontracting system in employment. President of the All-Indonesian Labour Confederation (KSPSI) Andi Gani Nena Wea claims to have received leaks from the government about the new rules. In the upcoming new rules, the outsourcing practice, which currently refers to the Omnibus Law on Job Creation, is said to change. “Previously, all types of work could be outsourced, with no time limits in the Omnibus Law. I have heard news and met directly with the government; (in the future) it will be limited to five types of work,” said Andi Gani during a press conference in Menteng, Central Jakarta, on Monday (27/4/2026). Based on information from the government, the outsourcing regulation will revert to referring to Law No. 13 of 2003 on Manpower. According to Andi Gani, the details of the new outsourcing rules will be officially conveyed by the government in the near future. He stated that the rules could be announced before the international labour day commemoration or May Day, which falls on 1 May 2026. Andi Gani said that the new outsourcing rules are a realisation of President Prabowo Subianto’s promise regarding labour complaints during last year’s May Day 2025 commemoration. Furthermore, he explained that the new outsourcing rules will be stipulated in the form of regulations at the level of the Ministry of Manpower (Kemenaker). In addition, the changes to the outsourcing rules will also be included in the new Manpower Law, which is currently still in the legislative process. “Currently, outsourcing still follows the Omnibus Law, which has resulted in many violations,” he said. “Finally, the President took quick action, issuing a Ministerial Regulation first until we follow up in the Manpower Law,” Andi Gani continued. Thus, according to him, there will no longer be outsourcing that exceeds certain time limits.
